"50 DAYS OF JAVA - CHANCE TO WIN" PROMOTION

Terms and Conditions

The following are the terms and conditions governing the “50 Days of Java – Chance to Win” promotion (“Promotion”):

1.     What is the “50 Days of JAVA – Chance to Win” Promotion about?

Digicel is offering its mobile customers (both Prepaid and Postpaid) customers a chance to win weekly prizes as well as a chance to win one (1) of two (2) grand prizes, subject to these terms and conditions, during the period from 12:00 a.m. on 14^th July, 2023 to 11:59 p.m. on 1^st September, 2023 (“Promotional Period”).

2.     What are the grand prizes to be won, what are the draw dates for each grand prize and what are the entry dates for eligibility to win the grand prizes?

The table below sets out specific details regarding the grand prizes to be won in this Promotion:

The entry dates for eligibility to win the above grand prizes are 14^th July, 2023 to 1^st September, 2023.

3.     What are the weekly prizes, what are the draw dates for the weekly prizes and what are the entry dates?             

The table below sets specific details regarding the weekly prizes to be won in this Promotion:

NB:  Once you have not won a weekly prize, your entries will be included in any other subsequent weekly draws.

4.     How many winners will there be for each weekly draw?         

The number of winners each week will vary, however, for this Promotion, there will be 177 prizes awarded (including the grand prizes).

5.     Can a weekly winner choose which prize they will receive?               

No. The weekly prize to a particular weekly winner will be randomly chosen.

6.     Will I be able to win a weekly prize for each of the weekly draw dates?

No. If you win a weekly prize, you will not be eligible to win another weekly prize during the Promotional Period, however, you will still qualify for a chance to win a grand prize.

7.     Will I be able to win another grand prize if I have already won a grand prize in this Promotion?

No. If you win a grand prize, you will not be eligible to win another grand prize in this Promotion.

8.     Are there any specific conditions attached to receiving the 1^st Grand Prize?

Yes, as the winner of the 1^st Grand Prize:

Ø  Flights - You will receive four (4) roundtrip economy airline travel tickets (“1^st GP Tickets”) to Orlando, USA (“Destination Country 1”) including transport from and to the airport to be used by you and three (3) travel companions of your choice.

Ø  Hotel- Accommodation for five (5) days and four (4) nights at a hotel to be decided by Digicel at its sole discretion.

Ø  Activities- Passes to access Disney experience

Additional conditions attached to the 1^st Grand Prize:-

-  1^st GP Tickets cannot be redeemed for travel points.

-  1^st GP Tickets are non-transferable, non-refundable and non-changeable.

-  The winner and travel companions must use tickets at the same time.

-  Travel must be before 31^st December, 2023

-  You, as the winner, and your travel companions must have a valid passport and US visa

9.     Are there any specific conditions attached to receiving the 2^nd  Grand Prize?

 Yes, as the winner of the 2^nd Grand Prize:

 Flights - You will receive two (2) roundtrip economy airline travel tickets (“2^nd GP Tickets”) to Guyana (“Destination Country 2”) including transport from and to the airport to be used by you and a travel companion of your choice.

 Tickets – You will receive two (2) VIP tickets to the final CPL game

 Accommodation – Accommodation for three (3) days and two (2) nights at a hotel to be decided by Digicel at its sole discretion. 

Additional conditions attached to the 2^nd Grand Prize:-

 2^nd GP Tickets cannot be redeemed for travel points.

 2^nd GP Tickets are non-transferable, non-refundable and non-changeable.

 You, as the winner, and your travel companion must have a valid passport.

10.  Are there any specific conditions attached to receiving both the 1^st Grand Prize and the 2^nd  Grand Prize?

 Yes, as the winners of the 1^st Grand Prize and the 2^nd Grand Prize:

You and/or your travel companions will be solely responsible for the following:-

- All associated costs and arrangements for baggage, luggage and/or carry-ons as well as meal and/or beverage options beyond the allowances provided by the particular airline.

- All associated costs and arrangements for obtaining and complying with any visa entry requirements or other immigration requirements as the case may be, as it relates to entering and/or exiting Trinidad as well as the Destination Country 1 or Destination Country 2 (whichever is applicable).

- All associated costs and arrangements in relation to government taxes implemented for entering and/or exiting Trinidad as well as the Destination Country 1 or Destination Country 2 (whichever is applicable).

- All associated arrangements and compliance procedures in relation to all stipulated vaccination policies of Trinidad and Tobago and the Destination Country 1 or Destination Country 2 (whichever is applicable) as may be required by law.

- Any travel insurance or medical expenses that may be purchased or incurred in preparation for or during the travel period.

-  Any losses or expenses incurred due to your or your travel companion/s’ late arrival for flights or travel or missing the travel dates or event dates that were pre-booked by Digicel.

- In the event that you and/or your travel companions are denied entry into the Destination Country 1 or Destination Country 2 (whichever is applicable) for whatever reason, Digicel will not be liable.

- All associated costs and arrangements for any other travel companions beyond the travel companions mentioned as part of the particular grand prize will be at the sole cost of the winner and will not be the responsibility of Digicel.

- Digicel shall not be liable whatsoever for any loss or damage incurred or suffered, death or personal injury suffered or sustained, or costs incurred, arising from the claiming of or use of the 1^st Grand Prize or the 2^nd Grand Prize.

-The winner and their travel companions will be asked to sign a release form. The winner and their travel companions will need to provide a hard-copy and an electronic version of the release form along with travel documents to Digicel within two (2) Working Days after confirmation as winner for travel. “Working Day” means any day other than a Saturday, Sunday or public holiday in the Republic of Trinidad and Tobago.

·       Winners and travel companions are responsible to arrive at the airport, as advised by Digicel, on time and according to the airline regulations to take the flight on time. If a winner and his or her travel companions miss the flight or pre-booked transport for any reason, the winner and his or her travel companions will be responsible for any additional costs incurred for alternate flight arrangements or alternative transport arrangements

11.   How can I enter this Promotion?

The following are the methods by which you can enter this Promotion during the Promotional Period:

- If you switch or port to Digicel’s mobile service

- If you purchase any Prepaid My Plan

- If you sign up for any Postpaid My Plan

All entries during the Promotional Period will be valid for a grand prize draw, provided that, if you win a grand prize, you will not be eligible to win another grand prize in this Promotion.

12.  How will winners be notified?

·       After a winner is randomly chosen for each of the weekly prizes or a grand prize, Digicel will place a call to that customer’s number. Digicel will make only one (1) attempt to call the selected number. If no one answers that call, then another winner will be randomly selected.

·       A winner shall be deemed the person identified (by the person answering the call) as the owner of the Digicel account (“the winner”). If, in Digicel’s sole opinion, the information given when Digicel placed the call to identify the winner is untrue, then Digicel reserves the right to have the prize returned to it by the purported owner and then to give the award to the rightful owner of the account associated with the winning entry selected.

·       The winner will also be announced on Digicel’s Facebook and Instagram page.

13.  How many times can I enter for a weekly draw? 

·       There is no limit to the number of times you can enter for a weekly draw.

·       Once you have not won a weekly prize, your entries will be included in any other subsequent weekly draws for this Promotion.

14.  How many times can I enter during the Promotional Period for the  chance to win a grand prize? 

·       There is no limit to the number of times you can enter during the Promotional Period for a chance to win a grand prize.

15.  Where can a winner collect his/her prize?  

·       A winner can collect his/her prize at Digicel’s head office located at 11C Maraval Road, Port-of-Spain.

16.  Conditions of Use

This Promotion is open to all Digicel mobile postpaid and prepaid customers except when roaming and except Corporate customers (and those who are not eligible as they fall into one of the categories identified in the terms below.)

            To enter and be eligible to win:

·       You must be a legal resident of  the Republic of Trinidad and Tobago

·       You must be 18 years of age or older

·       If you are a Digicel postpaid mobile subscriber, your account must be in good standing

            The following terms apply to All Digicel Customers:

·       Digicel will not notify participants of the number of entries obtained for this Promotion.

·       Persons in any of the following categories are NOT eligible to participate or win any of the prizes:

-        Any person who at any time on or after 14^th July, 2023 was or is a director, officer, employee, agent of Digicel (Trinidad & Tobago) Limited or any of their respective parent, subsidiary, or other affiliated companies, franchisees or service agencies or independent contractors

-        Individuals engaged in the development, production, advertising or distribution of materials for this Promotion (collectively the ”Promotional Entities”); and

-        Persons who are or purport to be immediate family members (defined as biological parent, step-mother, step-father, sister, brother, daughter, son or dependent or spouse of any of the foregoing) of any person in any of the preceding categories, regardless of where they live, or who reside in the same household as any person in any of the preceding categories (i.e. who have lived in the same household for at least three (3) of the twelve (12) months preceding  14^th July, 2023 whether those persons are related or not).

Conditions of Entry

·       Participants acknowledge that compliance with these terms and conditions including all eligibility requirements is a necessary pre-condition to any of the prizes being awarded to them. For removal of all doubt, participants who have not complied with these terms and conditions are subject to disqualification.

·       A winner may be required to provide Digicel with proof that he/she is the authorized account holder/owner of the Digicel account associated with the selected winning entry before the prize is given to him/her.

·       Winners shall be fully responsible for the payment of all taxes, duties or statutory deductions in relation to the prizes awarded for this Promotion.

·       Digicel reserves the right in its sole discretion to cancel, modify or suspend this Promotion at any time, if fraud, technical failures, including any network server or hardware failure, viruses, bugs, errors in programming, or any other errors or other causes beyond the control of Digicel corrupt the administration, security, integrity or proper conduct of this Promotion.

·       Digicel does not warrant that access to or use of the Digicel service will be uninterrupted or free of any of the events stated below, due to the nature of computer and wireless communications. Digicel and the Promotional Entities are not responsible for any problems that may arise, including but not limited to:

-        lost, interrupted, inaccessible or unavailable networks or other connection, availability or accessibility problems arising in connection with or over the course of this Promotion; 

-        communications failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions or hardware or software malfunctions, failures or difficulties; 

-        failure of personal computers and/or software and hardware configurations, any technical malfunctions, failures, or difficulties, printing errors, clerical, typographical or other error in the offering or announcement of the prizes or in the prize  notification;

-        for any errors of any kind in connection with this Promotion, whether human, mechanical, clerical, electronic, or technical in nature; or

-        the incorrect or inaccurate capture of information, or the failure to capture any information in connection with the Promotion.

·       Any attempt by an entrant or other individual to deliberately undermine the legitimate operation of this Promotion, including but not limited to any fraudulent claims, may be a violation of criminal and/or civil laws in the countries where this Promotion is being run. Should such an attempt be made, Digicel reserves the right to seek remedies and damages from any such individual, to the fullest extent permitted by law, including criminal prosecution.

·       In no event will Digicel be liable for more than the relevant prize available under these terms and conditions.

·       Prizes may not be transferred or exchanged for another product or for cash.

·       In the event of any conflict with any promotional details contained in these terms and conditions and promotional details contained in point of sale, television and print, advertising, promotional packaging and other promotional media, (“Promotional Materials”), the details of this Promotion set forth in these terms and conditions shall prevail.

·       The invalidity or unenforceability of any provision of these terms and conditions shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these terms and conditions shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Digicel employees are not authorized to waive, modify or amend any provision or provisions of these terms and conditions in any manner whatsoever.

·       All entrants agree to take part in any promotional, marketing or publicity activities or events reasonably requested by Digicel.  By participating in the Promotion, entrants consent to the use of their name, likeness, image, photograph for any and all programming and/or publicity or advertising purposes, commercial or otherwise, in all media and formats used by Digicel, its agencies or its affiliates, without further compensation, throughout the entire world in perpetuity. If a winner refuses to do so, they forfeit their right to claim a prize. 

·       Digicel reserves the right to award any forfeited prizes to another participant in the Promotion.

·       Warranty and support information relating to prizes will be included in product packaging.

·       Save in the event of its negligence, neither Digicel, nor any other person or party associated with the Promotion, their associated companies, agents, contractors and sponsors or any of its personnel involved in the Promotion, shall be liable whatsoever for any loss or damage incurred or suffered, death or personal injury suffered or sustained, or costs incurred, arising from either participation in the Promotion or from claiming any prize.

All values stated in these terms are conditions are in Trinidad and Tobago currency.

These terms and conditions are governed by the laws of the Republic of Trinidad and Tobago, the courts of which shall be of competent jurisdiction.
