TERMS AND CONDITIONS
The following are the terms and conditions governing this Promotion:
1. What is the “Digicel Christmas We In Everything– Chance to Win” Promotion (“Promotion”)?
Digicel is offering its mobile customers (both Prepaid and Postpaid) as well as its Digicel + customers a chance to win weekly prizes (“Weekly Prizes”) as well as a chance to win 1 of 5 grand prizes (“Grand Prizes”), subject to these terms and conditions.
2. What does this Promotion start and end?
This Promotion is valid from 12:00 a.m. on 7th November, 2022 to 11:59 p.m. on 31st December, 2022 (“Promotional Period”).
3. What are the Grand Prizes to be won, what are the draw dates for each grand prize and what are the entry dates for eligibility to win the Grand Prizes?

* “Digicel Services” means Digicel mobile services if the winner is an existing Digicel prepaid or postpaid mobile customer or Digicel+ services if the winner is an existing Digicel+ customer.
** The free 1 year service will begin from the next billing period immediately following the relevant draw date.
*** Any charges exceeding $15,000.00TT for the 1 year service period will not be covered by Digicel and shall be the winner’s responsibility.

NB: Once you have not won a Weekly Prize, your entries will be included in any other subsequent weekly draws.
5. How many winners will there be for each weekly draw?
There will be two (2) winners for each weekly draw.
6. Can a weekly winner choose which prize they will receive?
No. The weekly prize to a particular weekly winner will be randomly chosen.
7. Will I be able to win a Weekly Prize for each of the weekly draw dates?
No. If you win a Weekly Prize, you will not be eligible to win another Weekly Prize during the Promotional Period. However, you will still qualify for a chance to win a Grand Prize.
8. Will I be able to win another Grand Prize if I have already won a Grand Prize in this Promotion?
No. If you win a Grand Prize, you will not be eligible to win another Grand Prize in this Promotion.
9. Are there any specific conditions attached to receiving the 2nd Grand Prize?
Yes, as the winner of the 2nd Grand Prize:
- You must select your furniture and/or appliances from a courts store of your choice and submit the related invoice/s to Digicel within three (3) months from the date you are contacted by Digicel notifying that you are the winner.
- Any charges beyond the value of $50,000.00TT for selected furniture and/or appliances will not be covered by Digicel and shall be the winner’s responsibility.
10. Are there any specific conditions attached to receiving the 5th Grand Prize?
- Yes, as the winner of the 5th Grand Prize:
- You will receive two (2) Caribbean Airlines return travel tickets (“Tickets”) to New York valued at up to a total of $13,500 to be used by you and a travel companion of your choice.
- Tickets must be redeemed within one (1) year from the date that the winner is announced.
Additional conditions attached to the 5th Grand Prize:-
- Tickets cannot be redeemed for travel points.
- Tickets are non-transferable, non-refundable and non-changeable. The Tickets must be used by the winner and a travel companion of their choice at the same time.
- You, as the winner, and your travel companion must have a valid passport and visa and/or any other entry requirements including any health or medical screening requirements
You and your travel companion of your choice will be solely responsible for the following:-
- All associated costs and arrangements for complying with any quarantine protocols and procedures that may be required for exiting and/or entering Trinidad as well as the Destination Country.
- All associated costs and arrangements for baggage, luggage and/or carry-ons as well as meal and/or beverage options provided by Caribbean Airlines.
- All associated costs and arrangements for obtaining and complying with any visa entry requirements or other immigration requirements as the case may be, as it relates to entering and/or exiting Trinidad as well as the Destination Country.
- All associated costs and arrangements in relation to government taxes implemented for entering and/or exiting Trinidad as well as the Destination Country.
- All associated arrangements and compliance procedures in relation to all stipulated vaccination policies of Trinidad and Tobago and the Destination Country as may be required by law.
- All associated costs and arrangements for any other travel companions beyond the one (1) travel companion mentioned herein will be at the sole cost of the winner and will not be the responsibility of Digicel.
· In the event that you and your travel companion are denied entry into the Destination Country for whatever reason, Digicel will not be liable.
· Digicel shall not be liable whatsoever for any loss or damage incurred or suffered, death or personal injury suffered or sustained, or costs incurred, arising from the claiming of or use of this prize.
11. How can I enter this Promotion?
The following are the methods by which you can enter this Promotion during the Promotional Period:
- If you sign up as a Digicel+ customer, you will receive one (1) entry to this Promotion;
- As a Digicel mobile Postpaid customer, if you pay your bill on time and in full, you will receive one (1) entry to this Promotion
- As a Digicel + customer, if you pay your bill on time and in full, you will receive one (1) entry to this Promotion
- A customer who ports over to the Digicel network will receive sixty (60) entries to this Promotion
- Any customer purchasing a Prime Prepaid or Postpaid bundle, will receive entries to this Promotion based on the duration of the bundle purchased, For example, 1day Prime bundle will receive one (1) entry, 10 Day Prime bundle will receive ten (10) entries
NB. This only applies to advertised Prime bundles
All entries during the Promotional Period will be valid for a grand prize draw.
12. As a participant in this Promotion, can I view the number of entries that I receive during the Promotional Period?
Yes, you can view your number of entries (“Tokens”) in this Promotion by visiting the following website: https://service.digiceltt.com/promogui/
13. Are there any other methods of entry?
Yes:
- Digicel mobile customers who participate in the “Pick and win - Christmas 2022” Promotion can win entries to this Promotion and will be eligible to win one of the weekly prizes as well as a grand prize.
14. How will winners be notified?
· After a winner is randomly chosen for each of the weekly prizes or a grand prize, Digicel will place a call to that customer’s number. Digicel will make only one (1) attempt to call the selected number. If no one answers that call, then another winner will be randomly selected.
· A winner shall be deemed the person identified (by the person answering the call) as the owner of the Digicel account (“the winner”). If, in Digicel’s sole opinion, the information given when Digicel placed the call to identify the winner is untrue, then Digicel reserves the right to have the prize returned to it by the purported owner and then to give the award to the rightful owner of the account associated with the winning entry selected.
· The winner will also be announced on Digicel’s Facebook and Instagram page.
15. How many times can I enter for a weekly draw?
· There is no limit to the number of times you can enter for a weekly draw.
· Once you have not won a weekly prize, your entries will be included in any other subsequent weekly draws for this Promotion.
16. How many times can I enter during the Promotional Period for the chance to win a grand prize?
· There is no limit to the number of times you can enter during the Promotional Period for a chance to win a grand prize.
· Once you have not won a grand prize, your entries will be included in any other subsequent grand prize draw for this Promotion.
17. Where can a winner collect his/her prize?
· A winner can collect his/her prize at Digicel’s head office located at 11C Maraval Road, Port-of-Spain.
18. Conditions of Use
This Promotion is open to Digicel+ customers and all Digicel mobile postpaid and prepaid customers except when roaming and except Corporate customers (and those who are not eligible as they fall into one of the categories identified in the terms below.)
To enter and be eligible to win:
· You must be a legal resident of the Republic of Trinidad and Tobago
· You must be 18 years of age or older
· If you are a Digicel postpaid mobile subscriber, your account must be in good standing or if you are a Digicel+ customer, your account must be in good standing
The following terms apply to All Digicel Customers
· Digicel will not notify participants of the number of entries obtained for this Promotion.
· Persons in any of the following categories are NOT eligible to participate or win any of the prizes:
- Any person who at any time on or after 4th November, 2022 was or is a director, officer, employee, agent of Digicel (Trinidad & Tobago) Limited or any of their respective parent, subsidiary, or other affiliated companies, franchisees or service agencies or independent contractors
- Individuals engaged in the development, production, advertising or distribution of materials for this Promotion (collectively the ”Promotional Entities”); and
- Persons who are or purport to be immediate family members (defined as biological parent, step-mother, step-father, sister, brother, daughter, son or dependent or spouse of any of the foregoing) of any person in any of the preceding categories, regardless of where they live, or who reside in the same household as any person in any of the preceding categories (i.e. who have lived in the same household for at least three (3) of the twelve (12) months preceding 4th November, 2022 whether those persons are related or not).
Conditions of Entry
· Participants acknowledge that compliance with these terms and conditions including all eligibility requirements is a necessary pre-condition to any of the prizes being awarded to them. For removal of all doubt, participants who have not complied with these terms and conditions are subject to disqualification.
· The winner may be required to provide Digicel with proof that he/she is the authorized account holder/owner of the Digicel account associated with the selected winning entry before the prize is given to him/her.
· Winners shall be fully responsible for the payment of all taxes, duties or statutory deductions in relation to the prizes awarded for this Promotion.
· Digicel reserves the right in its sole discretion to cancel, modify or suspend this Promotion at any time, if fraud, technical failures, including any network server or hardware failure, viruses, bugs, errors in programming, or any other errors or other causes beyond the control of Digicel corrupt the administration, security, integrity or proper conduct of this Promotion.
· Digicel does not warrant that access to or use of the Digicel service will be uninterrupted or free of any of the events stated below, due to the nature of computer and wireless communications. Digicel and the Promotional Entities are not responsible for any problems that may arise, including but not limited to:
- lost, interrupted, inaccessible or unavailable networks or other connection, availability or accessibility problems arising in connection with or over the course of this Promotion;
- communications failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions or hardware or software malfunctions, failures or difficulties;
- failure of personal computers and/or software and hardware configurations, any technical malfunctions, failures, or difficulties, printing errors, clerical, typographical or other error in the offering or announcement of the prizes or in the prize notification documents;
- for any errors of any kind in connection with this Promotion, whether human, mechanical, clerical, electronic, or technical in nature; or
- the incorrect or inaccurate capture of information, or the failure to capture any information in connection with the Promotion.
· Any attempt by an entrant or other individual to deliberately undermine the legitimate operation of this Promotion, including but not limited to any fraudulent claims, may be a violation of criminal and/or civil laws in the countries where this Promotion is being run. Should such an attempt be made, Digicel reserves the right to seek remedies and damages from any such individual, to the fullest extent permitted by law, including criminal prosecution.
· In no event will Digicel be liable for more than the relevant prize available under these terms and conditions.
· Prizes may not be transferred or exchanged for another product or for cash.
· In the event of any conflict with any promotional details contained in these terms and conditions and promotional details contained in point of sale, television and print, advertising, promotional packaging and other promotional media, (“Promotional Materials”), the details of this Promotion set forth in these terms and conditions shall prevail.
· The invalidity or unenforceability of any provision of these terms and conditions shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these terms and conditions shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Digicel employees are not authorized to waive, modify or amend any provision or provisions of these terms and conditions in any manner whatsoever.
· All entrants agree to take part in any promotional, marketing or publicity activities or events reasonably requested by Digicel. By participating in the Promotion, entrants consent to the use of their name, likeness, image, photograph for any and all programming and/or publicity or advertising purposes, commercial or otherwise, in all media and formats used by Digicel, its agencies or its affiliates, without further compensation, throughout the entire world in perpetuity. If a winner refuses to do so, they forfeit their right to claim a prize.
· Digicel reserves the right to award any forfeited prizes to another participant in the Promotion.
· Warranty and support information relating to prizes will be included in product packaging.
· Save in the event of its negligence, neither Digicel, nor any other person or party associated with the Promotion, their associated companies, agents, contractors and sponsors or any of its personnel involved in the Promotion, shall be liable whatsoever for any loss or damage incurred or suffered, death or personal injury suffered or sustained, or costs incurred, arising from either participation in the Promotion or from claiming any prize.
