During the Promotional Period defined below, Digicel is offering its “JAVA Is For Family 2025 Promotion” (the “Promotion”).

These Terms and Conditions (the “Terms”) apply to you and govern your participation in this Promotion.

“We” or “us” means Digicel (Trinidad & Tobago) Limited (“Digicel”), a company registered under the laws of the Republic of Trinidad and Tobago with registered offices at 11C Maraval Road, Port of Spain, Trinidad. 

“I” or “you” means the person participating in the Promotion (and “my” and “your” shall have the same meaning).

By participating in the Promotion, you agree to be bound by these Terms.

These Terms incorporate the Privacy Policy which you can access via the Digicel’s website.

If you do not agree to or accept any of these Terms, or if you are under the age of eighteen (18), you should stop participating in the Promotion immediately.

1. What is the JAVA Is For Family 2025 Promotion about?

• During the period from 14th July, 2025 to 31st August, 2025 (“Promotional Period”), any Digicel prepaid mobile customer who purchases a 30 day D’Freedom Plan will receive 1GB T-Mobile USA Roaming Data and have a chance to win weekly and grand prizes.

• During each of the seven weeks (“Promotional Week”) of the Promotional Period, any Digicel prepaid mobile customer who purchases two D’1 Day Plans ($30 VAT inclusive) within a Promotional Week will get a FREE D’1 Day Plan.

Promotional Weeks:

• 14th July, 2025 to 20th July, 2025 (“1st Promotional Week”),

• 21st July, 2025 to 27th July, 2025 (“2nd Promotional Week”),

• 28th July, 2025 to 3rd August, 2025 (“3rd Promotional Week”),

• 4th August, 2025 to 10th August, 2025 (“4th Promotional Week”),

• 11th August, 2025 to 17th August, 2025 (“5th Promotional Week”),

• 18th August, 2025 to 24th August, 2025 (“6th Promotional Week”),

• 25th August, 2025 to 31st August, 2025 (“7th Promotional Week”)

Note: You must purchase both plans within the same Promotional Week in order to qualify for the FREE plan. Please note that qualifying balances are cleared at 11:59 p.m. every Sunday during the Promotional Period. You must use the FREE plan within 3 days of receiving the qualification message.

5. How can I purchase any of these plans?

Once you are a Digicel prepaid mobile customer, to purchase one of these plans, you can dial *323# or visit the My Digicel app only.

6. Will I qualify if I take a loan to purchase these plans?

No. Purchasing these plans via the use of Quick Credit will not be classified as a qualifying purchase.

7. The Roaming Data allocation for the US is new. Is this a permanent feature and where can it be used?

1GB of Roaming Data that can be used on the T-Mobile network in the 52 States of USA has been added to the D’ Freedom plan for the this Promotion only.

8.  Can I qualify for weekly prizes or grand prizes with a D’1 Day Plan purchase?

No. Customers purchasing the D’1 Day Plans are only eligible to receive a FREE plan after the purchase of two plans in an eligible Promotional Week.

9. Can I receive a FREE D’ Freedom plan if I purchase two D’ Freedom plans in a Promotional Week?

No. Customers purchasing the 30 Day D’ Freedom plan will only be eligible to win weekly and grand prizes.

10.  How can I enter this Promotion?

a. The following are the methods by which you can enter this Promotion during the Promotional Period to win weekly prizes or the grand prize:

• Purchase a 30 Day D’ Freedom Plan

All entries during the Promotional Period will be valid for a grand prize draw, provided that, if you win a grand prize, you will not be eligible to win another grand prize in this Promotion.

b. The following are the methods by which you can enter this Promotion during the Promotional Period to win a FREE D’1 Day Plan:

• Purchase two D’1 Day Plans within the same Promotional Week

11.  How many winners will there be for each weekly draw?

The number of winners each week will vary, however, for this Promotion, there will be 164 prizes awarded (including the grand prizes).

12.  How many winners will there be for the grand prize draw?

There will be 4 winners for the grand prize draw.

13.   Can a weekly winner choose which prize they will receive?

No. The weekly prize for a particular weekly winner will be randomly chosen.

14.   Will I be able to win a weekly prize for each of the weekly draw dates?

No. If you win a weekly prize, you will not be eligible to win another weekly prize during the Promotional Period, however, you will still qualify for a chance to win a grand prize.

15.   How will winners be notified?

• After a winner is randomly chosen for each of the weekly prizes or a grand prize, we will place a call to that customer’s number. We will make only one (1) attempt to call the selected number. If no one answers that call, then another winner will be randomly selected.

• A winner shall be deemed the person identified (by the person answering the call) as the owner of the Digicel account (“the winner”). If, in Digicel’s sole opinion, the information given when Digicel placed the call to identify the winner is untrue, then Digicel reserves the right to have the prize returned to it by the purported owner and then to give the award to the rightful owner of the account associated with the winning entry selected.

• The winner will also be announced on Digicel’s Facebook and Instagram page.

16.   How many times can I enter for a weekly draw?

There is no limit to the number of times you can enter for a weekly draw. Once you have not won a weekly prize, your entries will be included in any other subsequent weekly draws for this Promotion.

17.   How many times can I enter during the Promotional Period for the chance to win a grand prize?

There is no limit to the number of times you can enter during the Promotional Period for a chance to win a grand prize.

18.   Where can a winner collect his/her prize?

• A winner can collect his/her prize at Digicel’s head office located at 11C Maraval Road, Port-of-Spain.

19.   Will I be notified once I have qualified for the FREE D’1 Day Plan?

Yes, you will receive a text message on your mobile phone notifying you that you have qualified to receive a free Plan.

20.   How do I redeem my free D’1 Day Plan?

To redeem your free D’1 Day Plan you will be required to dial *345# and reply with ‘1’ to select plan.

21.   How long do I have to redeem the Free D’1 Day plan?

You will have three (3) days from the date that you receive the text message from Digicel with instructions to redeem your Free D’1 Day Plan.

22.   Will I be able to redeem the free plan while my D’1 Day Plan is active?

No. You cannot redeem the free plan while on an active D’1 Day Plan nor can you purchase a new D’1 Day Plan while the FREE plan is active.

23.   Conditions of Use

• This Promotion is open to all Digicel mobile prepaid mobile customers during the Promotional Period except those who are not eligible as they fall into one of the categories identified in the terms below.

              To enter and be eligible to win:

• You must be a legal resident of the Republic of Trinidad and Tobago

• You must be 18 years of age or older

              The following terms apply to All participants in this Promotion:

• Digicel will not notify participants of the number of entries obtained for this Promotion.

• Persons in any of the following categories are NOT eligible to participate or win any of the prizes:

• Any person who at any time on or after 14th July, 2025 was or is a director, officer, employee, agent of Digicel (Trinidad & Tobago) Limited or any of their respective parent, subsidiary, or other affiliated companies, franchisees or service agencies or independent contractors.

• Individuals engaged in the development, production, advertising or distribution of materials for this Promotion (collectively the “Promotional Entities”); and

• Persons who are or purport to be immediate family members (defined as biological parent, step-mother, step-father, sister, brother, daughter, son or dependent or spouse of any of the foregoing) of any person in any of the preceding categories, regardless of where they live, or who reside in the same household as any person in any of the preceding categories (i.e. who have lived in the same household for at least three (3) of the twelve (12) months preceding 14th July, 2025 whether those persons are related or not).

Conditions of Entry

• Participants acknowledge that compliance with these terms and conditions including all eligibility requirements is a necessary pre-condition to any of the prizes being awarded to them. For removal of all doubt, participants who have not complied with these terms and conditions are subject to disqualification.

• A winner may be required to provide Digicel with proof that he/she is the authorized account holder/owner of the Digicel account associated with the selected winning entry before the prize is given to him/her.

• Winners shall be fully responsible for the payment of all taxes, duties or statutory deductions in relation to the prizes awarded for this Promotion.

• Digicel reserves the right in its sole discretion to cancel, modify or suspend this Promotion at any time, if fraud, technical failures, including any network server or hardware failure, viruses, bugs, errors in programming, or any other errors or other causes beyond the control of Digicel corrupt the administration, security, integrity or proper conduct of this Promotion.

• Digicel does not warrant that access to or use of the Digicel service will be uninterrupted or free of any of the events stated below, due to the nature of computer and wireless communications. Digicel and the Promotional Entities are not responsible for any problems that may arise, including but not limited to:

• lost, interrupted, inaccessible or unavailable networks or other connection, availability or accessibility problems arising in connection with or over the course of this Promotion;

• communications failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions or hardware or software malfunctions, failures or difficulties;

• failure of personal computers and/or software and hardware configurations, any technical malfunctions, failures, or difficulties, printing errors, clerical, typographical or other error in the offering or announcement of the prizes or in the prize notification;

• for any errors of any kind in connection with this Promotion, whether human, mechanical, clerical, electronic, or technical in nature; or

• the incorrect or inaccurate capture of information, or the failure to capture any information in connection with the Promotion.

• Any attempt by an entrant or other individual to deliberately undermine the legitimate operation of this Promotion, including but not limited to any fraudulent claims, may be a violation of criminal and/or civil laws in the countries where this Promotion is being run. Should such an attempt be made, Digicel reserves the right to seek remedies and damages from any such individual, to the fullest extent permitted by law, including criminal prosecution.

• In no event will Digicel be liable for more than the relevant prize available under these terms and conditions.

• Prizes may not be transferred or exchanged for another product or for cash.

• In the event of any conflict with any promotional details contained in these terms and conditions and promotional details contained in point of sale, television and print, advertising, promotional packaging and other promotional media, (“Promotional Materials”), the details of this Promotion set forth in these terms and conditions shall prevail.

• The invalidity or unenforceability of any provision of these terms and conditions shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these terms and conditions shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Digicel employees are not authorized to waive, modify or amend any provision or provisions of these terms and conditions in any manner whatsoever.

• All entrants agree to take part in any promotional, marketing or publicity activities or events reasonably requested by Digicel. By participating in the Promotion, entrants consent to the use of their name, likeness, image, photograph for any and all programming and/or publicity or advertising purposes, commercial or otherwise, in all media and formats used by Digicel, its agencies or its affiliates, without further compensation, throughout the entire world in perpetuity. If a winner refuses to do so, they forfeit their right to claim a prize. 

• Digicel reserves the right to award any forfeited prizes to another participant in the Promotion.

• Warranty and support information relating to prizes will be included in product packaging. Where applicable, prizes awarded during this Promotion are subject to the manufacturer’s warranty and Digicel makes no representation as to the functionality of any of the prizes.

• All winners agree that participation in any activities which form part of a prize shall be at their own risk and Digicel shall not be liable for any damage, loss or injury suffered by you or any third parties as a result of such participation.

• Save in the event of its negligence, neither Digicel, nor any other person or party associated with the Promotion, their associated companies, agents, contractors and sponsors or any of its personnel involved in the Promotion, shall be liable whatsoever for any loss or damage incurred or suffered, death or personal injury suffered or sustained, or costs incurred, arising from either participation in the Promotion or from claiming/redeeming any prize.

All values stated in these terms are conditions are in Trinidad and Tobago currency.

Subject to the above, Digicel’s Mobile Telephone Services Terms and Conditions shall apply.

These terms and conditions are governed by the laws of the Republic of Trinidad and Tobago, the courts of which shall be of competent jurisdiction.
