PlayGo Emerge Competition

The following persons are NOT eligible to participate in the Competition:

a.     Person younger than 12 years.

b.     Persons who are not nationals of a Participating Market.

c.     Persons who have not downloaded the App and who do not have an active subscription.

d.     Employees, contractors, directors and officers of Digicel, their affiliated companies, distributors, web design, advertising, fulfillment and agencies  involved in the administration, development, fulfillment and execution of this Competition.

e.     Immediate family members of those persons described at (d), including spouse, parent child, sibling, grandparent or “step” of each category) and those living in their same households (those persons whether related or not who live in the same residence for at least three months during the twelve-month period preceding the start date of the Competition).

For Videos:

●      A length of less than 15 minutes.

●      16:9 horizontal or 9:16 vertical format.

●      Opening and/or closing credits are not required, but (if added) may add up to an additional 10 seconds in total.

●      Films produced may be in the language(s) or dialect(s) of their country/territory or have no dialogue at all. Non-English audio and important on-screen text must have English subtitles.

●      Accepted formats include .mp4 and .mov no larger than 500MBs. [1] Other formats will not [JH2] [KC3] be accepted.

●      Classifiable as of one of the following genres of film:

○      Documentary

○      Drama / Fiction

○      Comedy

○      Science Fiction

○      Animation

●      Reflecting the theme "Celebrate the National Pride of Your Country.”[JH4]

●      We will opt in to accommodate completed films dated from January 1, 2019 to present, counted as submissions in the competition.

For Photo Essays:

●      A minimum of 3 photos and a maximum of 10 photos.

●      Accepted formats include .pdf, .ppt or .mov.

●      Photos should tell a story clearly: include only those images required to tell a story as unnecessary images may reduce the overall impact of a submission.         

●      A maximum narrative of two written paragraphs (200 words) can accompany the essay, describing how the images relate to the theme and why the photos were chosen. An English translation must be provided if the narrative is in a language other than English.

●      Reflecting the theme "Celebrate the National Pride of Your Country.”

All content received in the PlayGo Emerge competition will be made available on the competition website until November 30, 2021.

The following prizes will be awarded to winning Entries for each category:

An internal screening committee comprising Digicel employees and contractors will review all submissions from participants and select a group of semi-finalists. Semi-finalist content pieces will be grouped by genre and judged by genre-specific juries comprised of industry professionals. Juries will select the finalist films and photo essays to be released to the public for voting on www.playgoemerge.com for all genre content. A final Grand Jury composed of industry experts will choose the Grand Prize winner among the pre-selected finalists. The public will have the opportunity to vote for a participant to receive the People’s Choice award from the finalist films. This will be done via the Website for a period of open voting by the public.

Winners will be contacted no later than October 1, 2021 via their personal email. Winners will also be announced on the PlayGo website and social media platforms.

12.1  By submitting an Entry to this Competition, each Participant warrants and represents that the Participant owns all rights to the Entry he/she/they is/are entering in this Competition, including, without limitation, the photographs or images, the written content, music, props, the video or digital recording, and the performances contained in each Entry. Each Participant further warrants and represents that the Participant has obtained permission from each person who appears in the entry to grant the rights to Digicel and the Competition, and upon request, will submit copies of such permissions to Digicel. By submitting an Entry, each Participant agrees to the Rules and further agrees to indemnify, hold harmless Digicel and their respective Affiliates, officers, directors, agents, co-branders or other partners and any of their employees, (collectively the Indemnitees), harmless from any and all claims, damages, expenses, costs (including reasonable attorney’s fees) and liabilities brought or asserted by any third party against any of the Indemnitees due to or arising out of the Participants Entry, or the Participant’s conduct during and in connection with this Competition, including but not limited to trademark, copyright, or other intellectual property rights, rights of publicity, right of privacy or defamation . The Participant agrees to release, indemnify and hold harmless Digicel from all claims against any material subsequently produced or prepared by or on behalf of Digicel using any material contained in any Entry which the Participant or a third party claims infringes on their rights.

12.2   By submitting an Entry or participating in the Competition, the Participant authorizes Digicel, its subsidiaries, Affiliates, divisions, successors and assigns and those acting under its permission, free of charge, worldwide to:                                         

           a) Reproduce, represent, adapt, and display the photo(s) and video(s) and (if any) his/her/their image and likeness appearing in the photo(s) and video(s) supplied to Digicel, in whole or in part, in composite or distorted character or form or as otherwise changed, or reproductions thereof, in color or otherwise, with a real or fictitious name, now or at any time in the future;                               

          b) Use, reproduce, distribute, make available, publish or broadcast by any process, means or media, including the Internet, the photo(s) and video(s) and (if any) his/her/their image and likeness appearing in the photo(s) and video(s) supplied to Digicel in way and manner Digicel deems fit within the scope of its internal and external communication, notably for advertising, editorial, promotional, marketing and public relation purposes;

          c) The Participant grants to Digicel all rights of every nature relating to the reproduction and use of such photo(s) and video(s), and waives any rights that he/she may have pursuant to any statute or law;

        d) By submitting an Entry or participating in the contest, the Participant declares that he/she owns the material supplied to Digicel and declares to be lawfully entitled to agree to the authorization herein and warrants that he/she has not granted any right to any third party that could impair or restrict his/her ability to carry out the rights granted hereunder.

        e) By entering the Competition, the winners acknowledge that they may be required to participate in publicity relating to the contest without further consent or payment. Such publicity may include, without limitation, the winner’s name and/or, their image or likeness, statements made by the winner concerning the contest.

        a.     The Competition is free to enter and no purchase of any kind is necessary for participation.

        b.     If a Participant is under the legal age of majority in your country, a parent or legal guardian must confirm their understanding and acceptance of these Terms on the Participant’s behalf.

        c.     Digicel reserves the right to, at its sole discretion, disqualify any individual found to be attempting to circumvent this requirement by tampering with the operation of the Competition, setting up multiple accounts, using multiple identities or acting in any manner deemed by Digicel to be in violation of these Terms or generally disruptive to the Competition.

        d.     If a Participant cheats, or if a virus, bug, catastrophic event or any other unforeseen or unexpected event that cannot be reasonably anticipated or controlled, affects the fairness and/or integrity of this Competition, Digicel reserves the right to cancel, change or suspend the Competition. This right is reserved whether the event is due to human or technical error. If there is no solution available to restore the integrity of the Competition, we reserve the right to select winners from among all eligible entries received before we had to cancel, change or suspend the Competition.

        e.     Digicel will validate the Entries to ensure they comply with applicable laws and internal codes of conduct.

        f.      Any breach of the rules will invalidate an Entry. If a breach has occurred but is discovered after the award of a prize, Digicel may request the prize be returned or compensation equivalent to the value of the prize.

        g.     Any local taxes payable for the acceptance of any prize will be paid solely by the prize winner.

        h.     Digicel reserves the right to substitute an alternative prize of similar value.

        i.       No warranty or guarantee is given by Digicel in relation to prizes produced or manufactured by third parties. Please contact the manufacturer of the prize, where applicable, for warranty information regarding your prize.

        j.       The prize is non-transferable, non-refundable, non-exchangeable, non-replaceable and non-redeemable for cash.

        k.     Digicel shall not be liable for any loss or damage suffered by any Participant or winner (including but not limited to indirect or consequential loss), or for any personal injury suffered or sustained as a result of collecting any prize, except for any liability that cannot be excluded by law.

        l.       Digicel’s decisions regarding the Competition will be final and binding. In the event of circumstances outside its reasonable control, Digicel reserves the right to cancel or amend the Competition or the Rules at any stage but will always endeavor to minimize the effect on Participants.

        m.   Participants will not be compensated in the event of cancellation or alteration of the Competition.

        n.     These Terms will be published in English only.

        o.     To ensure fairness and the integrity of the Competition to all Participants, Digicel will not enter into discussions regarding the running of this contest via social media, but will respond to any inquiry concerning the Competition sent to playgoappsubmissions@gmail.com.

        p.     Digicel may amend these Terms from time to time which will govern existing and future entries. Continue to check these Terms for updates. If a Participant does not agree to any such changes, the Participant must withdraw their Entry or immediately stop participating in this Competition.
