Referral Promotion Digicel+




The “Referral Promotion” (“Promotion”) terms and conditions (“Terms”) apply to you and govern your participation in the Promotion for chances to win certain prizes once you have paid your bill (“bill”). You should read these Terms carefully before participating in the Promotion.

“We” or “us” means Digicel Group Limited, a company registered under the laws of Bermuda with registered offices at Clarendon House, 2 Church Street, Hamilton HM11, Bermuda. References to “we”, “our” and “us” in these Terms also includes our subsidiaries and affiliates (“Affiliates”) from time to time including Digicel (Trinidad & Tobago) Limited, a company registered under the laws of the Republic of Trinidad and Tobago with its registered office at Third Floor, ANSA Centre, 11C Maraval Road, Port of Spain, Trinidad.

“I” or “You” means the person participating in, accessing or using the App to participate in the Promotion (and “my” and “your” shall have the same meaning).

By participating in this Promotion, you agree to be bound by these Terms.

If you do not agree to or accept any of these Terms, you should stop participating in the Promotion immediately.


1. What is the “Referral” promotion?

Digicel is offering Digicel+ customers the opportunity to participate in the “Referral” promotion, subject to these terms and conditions. This Promotion allows you, as a Digicel customer, to receive monetary credit to your Digicel+ bill.

Each participating customer that refers another person to sign up with Digicel+ can get $120 credit to their Digicel+ bill.


2.  What is the promotional period for this Promotion?

This Promotion is valid for the period from 12:00 a.m. on 16th March 2022 to 11:59 p.m. on 31st May, 2022 (“Promotional Period”).


3.  Who is eligible to enter this Promotion?

In order to be eligible for this Promotion (“Eligible Customer”):

·  You must be a legal resident of  the Republic of Trinidad and Tobago;

·  You must be 18 years of age or older;

·  You must be an active Digicel+ Customer; and

·  If you are a Digicel+ customer, your account must be in good standing.


Persons in any of the following categories are NOT eligible to participate in this Promotion or win any of the prizes:

-  Any person who at any time on or after 16th March 2022 was or is a director, officer, employee, agent of Digicel (Trinidad & Tobago) Limited or any of their respective parent, subsidiary, or other affiliated companies, franchisees or service agencies or independent contractors

- Individuals engaged in the development, production, advertising or distribution of materials for this Promotion (collectively the ”Promotional Entities”); and

-  Persons who are or purport to be immediate family members (defined as biological parent, step-mother, step-father, sister, brother, daughter, son or dependent or spouse of any of the foregoing) of any person in any of the preceding categories, regardless of where they live, or who reside in the same household as any person in any of the preceding categories (i.e., who have lived in the same household for at least three (3) of the twelve (12) months preceding 16th March 2022) whether those persons are related or not).


Digicel Corporate customers are excluded from participating in this Promotion.


4.  How does a Digicel+ customer participate in this Promotion?

·  To participate in this Promotion, you will need to be an active Digicel+ customer living at a specified address (participating communities)

· Refer a customer to sign up for Digicel+ service in the same community that you have existing Digicel+ service.

· The referrer and referee must reside within the same community.

5. How can a Digicel+ customer refer another customer to Digicel?

·  The Digicel team will share a QR code with the existing Digicel+ customer

·  An existing Digicel+ customer (referrer) distributes his/her assigned QR Code to referees

·  Once scanned the potential customer is taken to the Switch to Digicel form

·  Potential customer completes form, putting in area/MDU and submits it

·  Referrers will receive an update via phone upon successful completion of the sale.

·  The approved reward will be place on the customer’s (referrer) account by the Sales Support team


6.  How does my credit get applied for this Promotion?

·  Once the person referred has been successfully installed the credit will be applied to your account.

·  Credit amounts will be seen on your next bill


7.  How many new customers can a person refer?

·  There is no limit to the number of persons a customer can refer.

·  Referral credit will only be applied to the referrer’s account after the referee is installed.


8.   Will customers be notified when they receive the credit on their account?

·  A customer will see the credit on their next bill


9.   When will the referred customer receive their free HBO?

·  At the point of install the HBO service will be added to the customer’s account


10.  What will happen after the first month of HBO service?

·  The customer will be billed at normal rates for the HBO service from the second month.


11.  Can the customer remove the HBO service?

·  At any time the customer can call contact Digicel to have the HBO service removed from their account.


Additional Terms and Conditions


A.    Participants in this Promotion acknowledge that compliance with these Terms including all eligibility requirements is a necessary pre-condition to any of the prizes being awarded to them. For removal of all doubt, participants who have not complied with these Terms are subject to disqualification.


B.     This Promotion is offered for your personal use and not for commercial use and you agree not to sell any prizes redeemed through this Promotion.


C.    We reserve the right to disqualify you or terminate this offer if, in our sole opinion, the Promotion is being abused, such abuse to include but not be limited to selling or attempts to sell the prizes, whether on a commercial basis or otherwise, general abuse deemed as an attempt to undermine the integrity of our services.


D.    Digicel does not warrant that access to or use of the Digicel service will be uninterrupted or free of any of the events stated below, due to the nature of computer and wireless communications. Digicel and the Promotional Entities are not responsible for any problems that may arise, including but not limited to:

·  lost, interrupted, inaccessible or unavailable networks or other connection, availability or accessibility problems arising in connection with or over the course of this Promotion; 

· communications failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions or hardware or software malfunctions, failures or difficulties; 

·  failure of personal computers and/or software and hardware configurations, any technical malfunctions, failures, or difficulties, printing errors, clerical, typographical or other error in the offering or announcement of the prizes or in the prize  notification documents;

·  for any errors of any kind in connection with this Promotion, whether human, mechanical, clerical, electronic, or technical in nature; or

· the incorrect or inaccurate capture of information, or the failure to capture any information in connection with the Promotion.


E. Any attempt by an entrant or other individual to deliberately undermine the legitimate operation of this Promotion, including but not limited to any fraudulent claims, may be a violation of criminal and/or civil laws in the countries where this Promotion is being run. Should such an attempt be made, Digicel reserves the right to seek remedies and damages from any such individual, to the fullest extent permitted by law, including criminal prosecution.


F. The selected winners must have complied with these Terms to enter and be on an active, qualifying contract with no accounts held with Digicel being in arrears to be eligible to win the prizes.


G. We reserve the right to modify or discontinue (permanently or temporarily) this Promotion being offered to you at our discretion.


H. If a prize is unavailable, we may, in our discretion, substitute the prize with an alternative prize to the equal value and/or specification.


I. Prizes are not exchangeable and are not redeemable for cash.


J. We reserve the right to, at any time, with or without notice, vary or cancel the terms and conditions of this Promotion. In the event of us giving notice to you of any such changes to or cancellation of the Promotion, it shall suffice for us to give you notice via messages to your handset/device or to post such notification on the Digicel Trinidad website or the App. Any such notification shall be effective immediately or as of the date referred to in such notifications.


K.  In the event of any conflict with any promotional details contained in these terms and conditions and promotional details contained in point of sale, television and print, advertising, promotional packaging and other promotional media (“Promotional Materials”), the details of this Promotion set forth in these terms and conditions shall prevail.


L.  The invalidity or unenforceability of any provision of these terms and conditions shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these terms and conditions shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Digicel employees are not authorized to waive, modify or amend any provision or provisions of these terms and conditions in any manner whatsoever.


M. Any personal data relating to participants will be used solely for the purposes of this Promotion by Digicel and/or the Promotional Entities and will not be disclosed to a third party for any other purpose without the individual’s prior consent. By entering this Promotion, you consent to the use of your personal data by Digicel and/or Promotional Entities for the purposes of administration of the Promotion (including publishing your full name and county and/or disclosing it to third parties) and any other purposes to which you have consented. N.  In no event will Digicel be liable for more than the relevant prize available under these Terms.


O.  Save in the event of its negligence, neither Digicel, nor any other person or party associated with the Promotion, their associated companies, agents, contractors and sponsors or any of its personnel involved in the Promotion, shall be liable whatsoever for any loss or damage incurred or suffered, death or personal injury suffered or sustained, or costs incurred, arising from either participation in the Promotion or from claiming any prize.


P.  All entrants agree to take part in any promotional, marketing or publicity activities or events reasonably requested by Digicel.  By participating in the Promotion, entrants consent to the use of their name, likeness, image, photograph for any and all programming and/or publicity or advertising purposes, commercial or otherwise, in all media and formats used by Digicel, its agencies or its affiliates, without further compensation, throughout the entire world in perpetuity. If a winner refuses to do so, they forfeit their right to claim the prize (including the Grand Prize).
