Digicel’s “GoLoud Rewards You”

TERMS AND CONDITIONS 

 These Frequently Asked Questions (“FAQs”) and GoLoud Podcast Rewards Program Terms and Conditions (the “Terms”) apply to you and govern your participation in this Rewards Program for the opportunity to receive Reward Payment on the GoLoud mobile application (the “App”). You should read these FAQs and Terms carefully before participating in the Rewards Program.

“We” or “us” means Digicel (Trinidad & Tobago) Limited, a company registered under the laws of the Republic of Trinidad and Tobago with registered offices at 11C Maraval Road, Port of Spain, Trinidad. References to “we”, “our” and “us” in these Terms also includes our subsidiaries and affiliates (“Affiliates”) from time to time.

“I” or “you” means the person accessing or using the App to participate in the Rewards Program (and “my” and “your” shall have the same meaning).

By participating in the Rewards Program on the App, you agree to be bound by these Terms. These Terms incorporate the GoLoud Terms and Conditions of Use and Privacy Policy which you can access via the App. If you do not agree to or accept any of these Terms, or if you are under the age of eighteen (18), you should not participate in the Rewards Program and/ or stop participating immediately. 1.

1. Definitions

 Podcaster- a person who creates an audio or video recording and makes it available on GoLoud App.  User- Any individual who has listened to a podcast on the GoLoud App for the first time on a given day.

2. What is the “Digicel’s GoLoud Rewards You Program?

This is a GoLoud Podcast Rewards Program for Podcasters, who have uploaded new content onto the App from 1 st July, 2022 to the 31st August, 2022 and has signed up via the website, https://www.digicelgroup.com/tt/en/apps/go-loud/GoLoudPodcasts.html , to participate. The Podcasters will be compensated based on the number of Users per day who listens to their podcast which is available on the GoLoud App.

3. When does this Rewards Program start and end? This Rewards Program is valid from 1 st September 2022 to 30th November, 2022 (the “Rewards Program Period”).

4. Who can benefit from the Rewards Program? All Podcasters who are resident in Trinidad & Tobago and signs up via the website, https://www.digicelgroup.com/tt/en/apps/go-loud/GoLoudPodcasts.html , to participate in the Rewards Programme. 

5. How does the Rewards Program work?

Step 1: The Podcaster’s account must be available on GoLoud App and the Podcaster must have uploaded at least one new episode on the GoLoud App from the 1st July 2022 to the 31st August, 2022.

Step 2: The Podcaster will receive an email from Digicel confirming eligibility to participate in the Rewards Programme by completing and submitting the form located on the website, https://www.digicelgroup.com/tt/en/apps/go-loud/GoLoudPodcasts.html. Upon completing and submitting the form, the Podcaster will receive a confirmation email.

Step 3: Each Podcaster will be given a payment of $3.00TTD (vat exclusive) per User per day per episode (Reward Payment).

Step 4: Digicel will provide a written user report within one (1) Month after the completion of the Rewards Programme Period to the email address provided in the application form for the Rewards Programme for each Podcaster. This report will highlight the number of Users who qualified during the Rewards Programme Period for each Podcaster.

Step 5: The Podcaster to submit an invoice to akil.williams@digicelgroup.com within one (2) weeks after the user report has been made available. The invoice must include the number of Users, the base rate of $3.00TTD (vat exclusive) and the Rewards Program Period.

Step 6: Digicel to make payment to the Podcaster fourteen (14) days after the submission of the invoice. 

 Additional Terms and Conditions

A. This Rewards Program is offered for your personal use and not for commercial use and you agree not to sell any rewards redeemed through this Rewards Program . B. We reserve the right to disqualify you or terminate this offer if, in our sole opinion, the Rewards Program is being abused, such abuse to include but not be limited to selling or attempts to sell the Reward, whether on a commercial basis or otherwise, general abuse deemed as an attempt to undermine the integrity of our services. C. We reserve the right to modify, extend or discontinue (permanently or temporarily), this Rewards Program being offered to you at our discretion. D. We reserve the right to, at any time, with or without notice, vary or cancel the terms and conditions of this Rewards Program . In the event of us giving notice to you of any such changes to or cancellation of the Rewards Program , it shall suffice for us to give you notice via messages to your handset/device or to post such notification on the Digicel website or the App. Any such notification shall be effective immediately or as of the date referred to in such notifications. Any personal data relating to you will be used solely for the purposes of this Rewards Program by Digicel and/or by any agent appointed by us to assist with running the Rewards Program on our behalf and will not be disclosed to a third party for any other purpose without your prior consent. By entering this Rewards Program , you consent to the use of your personal data by Digicel and/or any agent appointed by it to assist with running the Rewards Program for the purposes of administration of the Rewards Program (including publishing your full name and county and/or disclosing it to third parties on request if you are a winner) and any other purposes to which you have consented. To see our Privacy Policy visit: www.digicelgroup.com. E. You agree to take part in any Rewards Program, marketing or publicity activities or events reasonably requested by Digicel. By participating in the Rewards Program , you consent to the use of your name, likeness, image, photograph for any and all programming and/or publicity or advertising purposes, commercial or otherwise, in all media and formats used by Digicel’s or its agencies, without further compensation, throughout the world in perpetuity. If you refuse to do so, you forfeit your right to participate in the Rewards Program. 

F. Except in the event of its negligence, neither Digicel, nor any other person or party associated with the Rewards Program , their associated companies, agents, contractors and sponsors or any of its personnel involved in the Rewards Program , shall be liable whatsoever for any loss or damage incurred or suffered, death or personal injury suffered or sustained, or costs incurred, arising from either participation in the Rewards Program or from receipt of Reward Payment and/ or Additional Reward Payment.
