The “#TherewithYou BiP Promotion” (the “Promotion”) frequently asked questions (“FAQs”) and Terms and Conditions (the “Terms”) apply to you and govern your participation in the Promotion. You should read these FAQs and Terms carefully before participating in the Promotion.
“We” or “us” means Digicel Caribbean Limited, a company registered under the laws of St. Lucia with registered office 1st Floor, Financial Centre, Bridge Street, Castries. References to “we”, “our” and “us” in these Terms also includes our subsidiaries and affiliates (“Affiliates”) from time to time.
“I” or “You” means the person accessing or using the BiP App (“App”) to participate in the Promotion (and “my” and “your” shall have the same meaning). By participating in the Promotion on the App, you agree to be bound by these Terms. These Terms are to be read with and incorporate the “BiP” Terms and Conditions which you can access via the App located in the ”More” section of your BiP App. If you do not agree to or accept any of these Terms, you should stop participating in the Promotion immediately.
1. What is the Digicel #ThereWithYou BiP Promotion?
This is a promotion offered to all Digicel Prepaid and Postpaid mobile customers who have downloaded the BiP Moblie Application (“App”) during the Promotional Period (as hereinafter defined). There are two elements of this promotion which are set out below:
1. BiP to BiP Messaging: All Prepaid and Postpaid Digicel customers (excluding Corporate customers) who are not on an active Eligible plan (as listed in Question 7 below) are able to utilize the “BiP to BiP messaging” feature on the App with no charge for the associated data use during the Promotional Period.
2. BiP Features: All Prepaid and Postpaid Digicel customers (excluding Corporate customers) who are on an active Eligible Plan are able to utilize the features listed below:
“BiP to BiP Messaging”;
BiP to BiP Voice calls; and
One-to-One video calling on BiP
With no charge for the associated data use during the Promotional Period.
A Fair Usage Policy (“FUP”) applies in respect of specified BiP features associated with this promotion.
2. What is BiP?
BiP is a communications app, owned by Lifecell Ventures, that brings relevant local content, including news and specific updates, messaging, voice, video calling and much more. It is an Over the Top Application (“OTT”) and so is available for use on any mobile network (not just Digicel) and on WiFi internet. BiP works in the same way as any other messenger application however offers a wider range of services and dynamic content relevant to the countries we live and work in. Digicel has partnered with BiP to provide exclusive benefits for Digicel mobile customers, such as this promotion.
3. Who is eligible to enter the Promotion ("Eligible Customers")?
In order to be eligible to participate in this Promotion, you must be a Digicel Prepaid or Postpaid customer who downloads the BiP app on the following devices:
- Android: Android 2.3 onwards and 100MB+ available storage on phone
- iPhone: iOS 7 onwards and 100MB+ available storage on phone
4. How do I participate in the Promotion?
In order to participate in the Promotion, Digicel customers simply need to download and install BiP (see ‘How do I get BiP’ in Question 5 below). The features, as described below (Question 8), will be zero-rated by Digicel automatically. In other words for the duration of the Promotional Period any use outlined will not deplete from your data allowance or credit.
5. How do I get Bip?
a. To access the App, you may either download the application to your mobile device from Google Play or the Apple App store, create an account and sign in.
b. You can download the BiP App on WiFi internet or using an existing data plan.

6. What is the Promotional Period for the Promotion?
The Promotion is valid from 12:01 on 1st October, 2020 through to 23:59 on 31st October, 2020 (the “Promotional Period”).
7. Which Prepaid/Postpaid bundles/plans are included in the promotion?

8. What features are included in the Promotion?
During the Promotional Period:
All Digicel Prepaid and Postpaid customers will receive:
BiP to BiP messaging: messages sent from one BiP app user to another BiP App. Therefore, Digicel Customers will not consume any data allowance or credit
Digicel customers with an active Eligible Plan will receive the following:
a. BiP to BiP messaging: messages sent from one BiP app user to another BiP App. Therefore, Digicel Customers will not consume any data allowance or credit;
b. BiP to BiP Voice calls; and
c. One-to-One video calling on BiP
Eligible Digicel customers will not consume any data allowance or credit.
9. What features of BiP are excluded from this Promotion?
The features specified below are excluded from this promotion:
- Group- (more than one-to-one) video calling – accessed via messages or the call menu;
- Discover- a market place that allows you to explore your interests and access or subscribe directly to services that peak your attention;
- Games – accessed through the games menu icon; and
- Analytics tool
You may access these excluded features listed in this section, however this usage will deplete from your data allowance or credit at our Pay As You Go rates.
10. Will I be notified before using a feature not included in the Promotion?
You will be reminded periodically by an in-app message prompt within the BiP app about features not included in the promotion and will therefore incur additional charges or data use if you choose to proceed. This prompt will not be before you use the feature.
11. Is there a Fair Usage Policy for this Promotion?

Additional Terms and Conditions
A. This product is offered for your personal use and not for commercial use.
B. You are solely responsible for all associated fees and costs incurred by you for connectivity and data usage in relation to your use of the App. Be reminded that once roaming, you will not be able to use any data from your local Prepaid or select Postpaid plans.
C. We reserve the right to terminate this offer if, in our sole opinion, the promotion is being abused, such abuse to include but not be limited to reselling or attempts to resell the content, whether on a commercial basis or otherwise, general abuse deemed as an attempt to undermine the integrity of our services.
D. We reserve the right to modify or discontinue (permanently or temporarily), this promotion being offered to you at our discretion.
E. We reserve the right to, at any time, with or without notice, vary or cancel the terms and conditions of this promotion. In the event of us giving notice to you of any such changes to or cancellation of the promotion, it shall suffice for us to give you notice via messages to your handset/device or to post such notification on the Digicel website or the App. Any such notification shall be effective immediately or as of the date referred to in such notifications.
F. You accept that certain content on the App may not be available in your country or in your preferred language due to contractual licensing restrictions. Please note that content available in your current location may become unavailable to you if you travel to another location in which content is restricted.
