Digicel is offering you simply more through the “Billo Video Ad Promotion” (the “Promotion”), by giving you the chance to win a prize by producing your best ad for the Billo Storage App (the “App”).

 

These Frequently Asked Questions (“FAQs”) and Terms and Conditions (the “Terms”) apply to you and govern your participation in the Promotion. You should read these FAQs and Terms carefully before participating.

 

“We” or “us” means Digicel Caribbean Limited, a company registered under the laws of St. Lucia with registered offices at 20 Micoud Street, Castries St. Lucia. References to “we”, “our”, “us” and “Digicel” in these Terms also include our subsidiaries and affiliates (“Affiliates”) from time to time.

 

“I” or “you” means the person participating in the Promotion by submitting a Video Ad (and “my” and “your” shall have the same meaning).

 

By participating in the Promotion, you agree to be bound by these Terms.

 

These Terms incorporate the Billo Terms of Use and Privacy Policy, which you can access via the App.

 

If you do not agree to or accept any of these Terms, or if you are under the age of eighteen (18), you should not participate in the Promotion.

 

1.    What is the “Billo Video Ad Promotion”?

The Promotion involves you producing and sending what you believe is the “best video ad” for Billo that depicts either a key feature or the key features of the App to get more consumers to use it over other competing storage apps without naming any other storage app (“Video Ad”).

 

2.    What kind of prizes can I win?

The prizes are as follows:

First Place	Sony A7S3 camera plus lens kit and a contract worth fifteen thousand United States dollars (US$15,000) to produce video content for Billo (“Prize Contract”)
Second Place	Sony A7S3 camera plus lens kit
Third Place	One thousand five hundred United States dollars (US$1,500)

 

3.    Where can I find information about the App

You can find all the information you need to produce your Video Ad by visiting www.mybilloapp.com or downloading the Billo application from the Google Play Store or Apple Store.

 

4.    When does the Promotion start and end?

The Promotion is valid from May 7, 2021 through to June 18, 2021 (the “Promotional Period”).[JH1]

5.    Who can submit a video ad for the promotion?

Anyone with an active Billo account who is over the age of eighteen (18), is following @mybilloapp on Instagram and is a resident in a Participating Market, as defined below.

 

Exclusions

The following persons may not participate in the Promotion:

a.    Postpaid corporate & business account customers;

b.    Any person who, at any time on or after August 1st, 2020, was or is a director, officer, employee, or agent of Digicel or any of its respective parents, subsidiaries, divisions, or affiliated companies, franchisees or service agencies, independent contractors or suppliers of services to Digicel;

c.     Families of our employees;

d.    Employees and families of employees of any company associated with this Promotion;

e.    Digicel Postpaid customers with overdue amounts;

f.      Persons under the age of eighteen (18); and

g.    Any person who does not reside in one of our Participating Markets (as defined below).

6.    Which Digicel markets are participating in this Promotion?

You may participate in the Promotion if you reside in any of the following countries (“Participating Markets”):

7.    How does the Promotion work?

Follow these steps to participate in the Promotion:

Step 1: Ensure that you are following @mybilloapp on Instagram, have the App installed and that you have an active account on the App. You may register for a new account if you do not already have one.

Step 2: Upon registration you will receive 5GB of free storage. Upload your Video Ad in MP4 format to your personal storage.

Step 3: To submit your Video Ad, send an email to billopromotions@digicelgroup.com including your full name, phone number, Instagram handle, and copied public Billo link to your Video Ad.

Step 4: Subject to our Additional Terms and Conditions below, your submitted Video Ad will then be reviewed by our panel of at least ten (10) judges, who will determine the first, second, and third prize winners and prepare a list of runners-up in order of priority.

8.    When will the winner be announced?

The winner will be announced on July 2, 2021 on our Instagram profile.

 

9.    What do I need to know before producing my Video Ad?

You agree that you will submit your original Video Ad in MP4 format, and that it will not contain any material that:

(a)  negatively mentions any competitors of Billo including any brand that provides online or cloud storage;

(b)  is unlawful, defamatory, obscene, for adults only, pornographic, indecent, lewd, suggestive, harassing, threatening, intimidating, abusive, inflammatory, disturbing or fraudulent;

(c)   contains any private or personal information of anyone without that person’s consent or other lawful bases, or which may damage anybody’s private life, personality or rights;

(d)  in not originally created by you or that violates anyone’s intellectual property rights;

(e)  is discriminatory in any way, including based on gender, religion, race, skin colour, language, sexuality, ethnicity, class, or disability;

(f)    contains drug use or substance misuse;

(g)  contains or is related to self-injury (self-inflicted cutting, suicide related content, etc.);

(h)  includes the image or likeness of a child without permission from that child’s parent or guardian;

(i)    would constitute, encourage, or provide instructions for a criminal offense, violation of the rights of any person or otherwise create liability or violate any local, state, national or international law;

(j)    contains or depicts any statements, remarks or claims that do not reflect your honest views and experiences;

(k)   impersonates, or misrepresents your affiliation with, any person or entity;

(l)    contains any promotions, political campaigning, advertising, commercial content or solicitations which are illegal or contrary to general ethics and the order of society;

(m) contains any viruses, corrupted data or other harmful, disruptive or destructive files or content;

(n)  may be subject to any legal, administrative, or penal proceeding, sanction or demands; or

(o)  is, in our judgment, objectionable, contrary to general ethics and the order of society, or restricts or inhibits any other person from using or enjoying the App, or that may expose Digicel or others to any harm or liability of any type.

 

10.  What will happen if I win?

(1)  If your video is selected by our panel of judges, you will receive a phone call from one of our representatives notifying you that you have won and requesting information from you such as your age, location and identity.

(2)  A maximum of three (3) attempts will be made to call you within a period of three (3) working days.

(3)  If you do not answer any of our calls, the next participant on the judges’ prioritized list of runners-up will be selected for that prize.

(4)  During the telephone call our Digicel representative will advise you where and how to redeem your prize.

(5)  Once you have spoken to our representative, you will have up to fourteen (14) days to redeem your prize, or your prize will be forfeited.

(6)  To collect your prize, you must still have an active Billo account and be following the @mybilloapp Instagram page at the time of collection and you must present valid government-issued proof of identification, which clearly indicates your age and that you are a legal resident of one of the Participating Markets.

(7)  You agree that if you win, you will permit photographs of you to be taken and for your image, likeness and name (your “Likeness”) to be used for public relations and marketing purposes free of cost, including the worldwide, perpetual, royalty-free publishing of your Likeness on social media, mainstream media, and other platforms that we may choose.

(8)  If you are unable to attend the scheduled prize collection, you may send a representative on your behalf with appropriate identification for you as well as that representative, along with a signed letter by you authorizing the collection.
