Digicel is offering you simply more through the BiP “Chat with Santa” Christmas 2020 Promotion (the “Promotion”), by providing all BiP subscribers with the opportunity to have your wishes granted this Christmas season. 

These Frequently Asked Questions (“FAQs”) and Terms and Conditions (the “Terms”) apply to you and govern your participation in the Promotion for chances to receive certain requested gifts via the BiP mobile application (the “App”). You should read these FAQs and Terms carefully before participating in the Promotion.

“We” or “us” means Digicel [Jamaica] Limited, a company registered under the laws of Jamaica with registered offices at 14 Ocean Boulevard. References to “we”, “our” and “us” in these Terms also includes our subsidiaries and affiliates (“Affiliates”) from time to time.

“I” or “you” means the person accessing or using the App to participate in the Promotion (and “my” and “your” shall have the same meaning).

By participating in the Promotion on the App, you agree to be bound by these Terms.

These Terms incorporate the BiP Terms of Use and Privacy Policy which you can access via the App.

If you do not agree to or accept any of these Terms, or if you are under the age of eighteen (18), you should stop participating in the Promotion immediately.

1.    What is the BiP “Chat with Santa” Christmas 2020 Promotion?

The Promotion allows you to send gift requests via the chat function on the App in the “Chat with Santa” Discover channel, for chances to receive those gifts.

2.    When does the Promotion start and end?

The Promotion is valid from December 16, 2020 through to January 8, 2021 (the “Promotional Period”).

3.    Can I take part in the Promotion?

All users of the App who are subscribed to the “Chat with Santa” Discover channel (the “Channel”) may participate in the Promotion.


The following persons cannot claim any gifts in the Promotion:

a.    Any person who, at any time on or after April 1st, 2020, was or is a director, officer, employee, or agent of Digicel Jamaica or any of their respective parents, subsidiaries, divisions, or affiliated companies, franchisees or service agencies, independent contractors or suppliers of services to Digicel (Jamaica) Limited;

b.    Any person who is not a legal resident of Jamaica and

c.     Any person under the age of 18.

4.    How does the Promotion work?

Follow these steps to participate in the Promotion:

Step 1: Download and install the App from the Google Play Store or Apple App Store.

Step 2: Subscribe to the “Chat with Santa” channel on the Discover section of the App.

Step 3: In the channel, select the “Chat with Santa” button to start a chat.

Step 4: Send us a message with the gift that you have chosen to wish for from the list of gifts provided in the Channel. You may send as many wishes as you would like.

Step 5: A weekly winner will be chosen based on the time that they submitted their wish. Participants are required to submit their wish between the hours of 12:01pm and 4:00pm, the first person to submit their wish during this time frame each Friday during the promotion will be deemed the winner and have their wish granted. We will announce all winners in the Channel and on our social media pages.


5.    Will I be notified when to participate?

Yes.  During the Promotional Period you will receive alerts via the Channel reminding you to send your wish for a chance to receive a gift. We will also post on our social media pages daily.

6.    When will winners be announced?

We will announce weekly winners every Friday starting on December 18, 2020. The draw dates are as follows:

7.    Can I wish for anything I want?

You will be able to select and wish for a gift from a list of Santa’s gifts provided in the Channel. No wishes for gifts outside of the scope of this list will be granted. The list of gifts are set out below:

8.    What do I need to know about collecting my gift if my wish is granted?

(1)  If your wish is granted, you will receive a phone call from one of our representatives notifying you and telling you how and when you can collect your gift.

(2)  Once you have spoken to our representative, you will have up to fourteen (14) days to collect your gift at 14 Ocean Boulevard or your gift will be forfeited.

(3)  To collect your gift, you must still be a subscriber of the Channel at the time of collection and you must present valid proof of identification, which clearly indicates your age and that you are a legal resident of Jamaica.

(4)  You agree that if you are selected to receive a gift, you will permit photographs of you to be taken and for your image, likeness and name (your “Likeness”) to be used for public  relations and marketing purposes free of cost, including the publishing of your Likeness on social media, mainstream media, the App and other platforms that we may choose.

(5)  If you are unable to attend the scheduled gift collection, you may send a representative on your behalf with appropriate identification for you as well as that representative along with a signed letter by you authorizing the collection.

(6)  Warranty and support information, where applicable, will be included in product packaging.


Additional Terms and Conditions

A.    This Promotion is offered for your personal use and not for commercial use and you agree not to sell any gifts received through this Promotion.


B.    You are required to use a compatible smartphone to run the App and participate in the Promotion. A compatible smartphone is an Android (OS 4.0 or higher) or Apple (iOS 2.0 or higher) smartphone.


C.   We reserve the right to disqualify you or terminate this offer if, in our sole opinion, the Promotion is being abused, such abuse to include but not be limited to selling or attempts to sell the gifts, whether on a commercial basis or otherwise, general abuse deemed as an attempt to undermine the integrity of our services.


D.   You are solely responsible for all associated fees and costs incurred by you for claiming and collection of gifts and for connectivity and data usage in relation to your use of the App.


E.    Please note that once roaming, you will not be able to participate in the Promotion.


F.    We reserve the right to modify, extend or discontinue (permanently or temporarily), this Promotion being offered to you, at our discretion.


G.   When you send messages in the Channel, including your wishes, we may respond to you with a message, but we are not obligated to do so. Whether you receive a response or not, does not affect your chances of being selected.


H.   If a gift that we have granted is unavailable, we may, in our discretion, substitute the gift with an alternative gift of equal value and/or specification.


I.      We also reserve the right to award any forfeited gift to another random participant of the Promotion;


J.    Gifts are not exchangeable and are not redeemable for cash.


K.    We reserve the right to, at any time, with or without notice, vary or cancel the terms and conditions of this Promotion. In the event of us giving notice to you of any such changes to or cancellation of the Promotion, it shall suffice for us to give you notice via messages to your handset/device or to post such notification on the Digicel website or the App. Any such notification shall be effective immediately or as of the date referred to in such notifications.


L.    Any personal data relating to you will be used solely for the purposes of this Promotion by Digicel and/or by any agent appointed by us to assist with running the Promotion on our behalf and will not be disclosed to a third party for any other purpose without your prior consent. By entering this Promotion, you consent to the use of your personal data by Digicel and/or any agent appointed by it to assist with running the Promotion for the purposes of administration of the Promotion (including publishing your full name and country and/or disclosing it to third parties on request if you are a winner) and any other purposes to which you have consented. M.   Except in the event of its negligence, neither Digicel, nor any other person or party associated with the Promotion, their associated companies, agents, contractors and sponsors or any of its personnel involved in the Promotion, shall be liable whatsoever for any loss or damage incurred or suffered, death or personal injury suffered or sustained, or costs incurred, arising from either participation in the Promotion or from claiming or collecting any reward.
