THE “SHAKE IT TO WIN IT PROMOTION” TERMS AND CONDITIONS

These My Digicel “Shake It To Win It Promotion” (the “Promotion”) frequently asked Questions (“FAQ”) and Terms and Conditions (the “Terms”) apply to you and govern your participation in the Promotion for chances to win certain prizes on the My Digicel mobile application (the “App”). You should read these FAQs and Terms carefully before participating in the Promotion.

“We” or “us” means Digicel Jamaica Limited, a company registered under the laws of Jamaica with registered offices at 14 Ocean Boulevard, Kingston, Jamaica. References to “we”, “our” and “us” in these Terms also includes our subsidiaries and affiliates (“Affiliates”) from time to time.

“I” or “You” means the person accessing or using the App to participate in the Promotion (and “my” and “your” shall have the same meaning).

By participating in the Promotion on the App, you agree to be bound by these Terms.

These Terms incorporate the MyDigicel Terms and Conditions and Privacy Policy which you can access via the App.

If you do not agree to or accept any of these Terms, you should stop participating in the Promotion immediately.

 

1.       What is the “Shake It to Win It” Promotion”?

Digicel is offering its prepaid and postpaid customers the opportunity to participate in the “Shake It to Win It Promotion” subject to these terms and conditions. The Promotion allows you to WIN prizes by topping up with $300 or more or purchasing an eligible plan valued at $60 or more and shaking your phone via the Shake It gaming mechanism in the MyDigicel app. Each participating customer will have a chance to win prizes and cash daily.

2.       What is the promotional period for the Promotion?

This promotion is valid from Friday, June 19, 2020 12:01 am through to Wednesday, September 30, 2020 at 11:59:59 pm.

3.       Who is eligible to enter the Promotion, “Eligible Customers”?

In order to be eligible to participate in this Promotion, you must be a Digicel prepaid or postpaid customer who has purchased an eligible plan valued at $60 or more from the selection of “Eligible Plans” as defined below or topped up with $300 or more. This includes customers who activate a new Eligible Plan during the promotional period as well as customers on an existing Eligible Plan.

The following customers are excluded from participating in the Promotion:

a.     Postpaid Corporate & Business account customers;

b.     Employees/families of employees (Spouse and Children), employees of affiliates companies associated with this promotion and

c.     Home & Entertainment only customers.

d.     Postpaid customers with overdue amounts

 

 

4.       Which Digicel prepaid/postpaid bundles/plans are included in the Promotion?

Postpaid Plans

All ACTIVE postpaid consumer customers eligible for this promotion (Legacy & Freedom Plans)

Customers can also find the list of eligible plans in the Shake It section of the App identified with the Shake It Icon {}.  As such plans listed in the My Digicel App that do not have the Shake It icon are excluded from the Promotion.

 

5.       How does a customer participate in the Promotion?

                    i.        To participate in the Promotion you will need to activate an eligible plan valued at $60.00 or more via any plan activation channel (MyDigicel App, UMM/USD Code - *147# and online via Digicel’s website) or top up with $300.00 or more.

                   ii.        Eligible Customers will receive a Shake It notification inviting them to participate in the Promotion.

                  iii.        By clicking on the Shake It notification and accepting the terms and conditions of same, the customer has confirmed their participation in the Promotion.

                  iv.        Once an Eligible Customer agrees to participate in the promotion, they can then shake to win!

                   v.        Please note the Shake It action must be completed in the MyDigicel app.

                  vi.        The Promotion includes a “Guaranteed Win” day (subject to the applicable Promotion terms and conditions as outlined below) on Saturdays and “Chances to Win” on every other day.

·         Guaranteed Win: Every Saturday during the promotional period, customers who have an active Eligible Plan will receive an SMS push and/or an In App notification to play Shake It for a guaranteed prize.

Sample SMS: Great! You just activated or already an eligible plan in the MyDigicel App Shake It To Win It promo! Shake now for a guaranteed chance of winning a prize.

·         Chance to Win: Every other day, Eligible Customers stand a chance of winning a prize after activating a NEW Eligible Plan and will receive an SMS push and/or an In App notification to play Shake It for a chance to win a prize.

Sample SMS: Thanks for activating an eligible plan in our Shake It To Win It promo! Shake now for a chance to win a prize.

                 vii.        Chance to Win Eligibility: Eligible Customers will have twenty four [24] hours from the issue date and time of your Shake it notification to Shake your device and enter for a chance to win a prize in the MyDigicel app. The Shake It action must be completed in the MyDigicel app.

                viii.        Guaranteed Win Eligibility: the Shake It action must be completed in the MyDigicel app on Saturdays during the promotional period for Eligible Customers to receive their instant win prize.

                  ix.        This Promotion will be accessible to Eligible customers while roaming, but any prizes won will only be available for redemption in Jamaica.

6.       Will customers be notified when to participate in Promotion?

·         Yes. Every Saturday during the Promotional Period, customers will be notified about the Guaranteed Win being available.

·         Whenever a Customer activates an Eligible Plan, they will also receive an SMS notification that they are eligible for a Chance to Win on any other day.

7.       How many times can a customer win?

The maximum number of wins per Customer is once (1) per day utilizing the My Digicel App. Winners of daily cash prizes are eligible to win more than once.

8.       Rewards and Prizes

a.     The Digicel Shake It to Win It Reward Pool will consist of Instant Win Prizes and Daily Cash Prizes, included in the table below:

The draw dates for this promotion are set out below:    

a.     The daily cash prize shall be won by a customer who participates in Shake It on each day starting July 6, 2020 between 12:01 am and 11:59 pm. The draws shall take place at Digicel (Jamaica) Limited, HQ, 14 Ocean Boulevard, Kingston and be conducted via the MyDigicel app by our internal rewards service application at 11:59pm. The app will randomly select a customer from the eligible customers to win the daily prize of Twenty-Five Thousand Dollars ($25,000.00).

b.     Voice and data bundle rewards will be allocated immediately to Eligible Customers who have won these rewards.

c.     Bundles will be available to use from allocation (within any specified usage period) and will expire as per the bundle’s validity period.

d.     Unused reward bundles will expire and there will be no rollover, with the exception of data bundles (as per existing rules regarding data bundle rollover).

e.     Reward bundles cannot be transferred to other customers, with the exception of data bundles (as per existing rules regarding data bundle transfer).

f.      Any usage that falls outside the specified usage period or after the bundle is depleted, will be billed at the applicable price plan rates.

g.     Daily cash prize winners can win more than once.

            Daily Cash Prizes redemption process and use:

h.     On winning a prize in this category, the Customer will receive a notification to the phone used for the ‘Shake It to Win It’ activity including:

                            i.        A voucher with a picture of the prize (for illustrative purposes only);

                           ii.        A description of the prize with a QR code; and

                          iii.        A telephone number to contact Digicel to arrange prize collection.  

i.      Once the winners have been contacted by Digicel and their entries validated, their telco prize shall be instantly redeemed and the cash prizes sent directly to their bank account.

j.      The Customer acknowledges that by participating in this promotion, Digicel shall be awarding the daily winner $25,000.00.

k.     Upon claiming the daily $25,000.00 cash prize, the customer shall be required to complete a digital redemption form.

l.      Customers are required to claim or redeem their cash prize within fourteen (14) days from the issue date of the notification of the prize win or the prize will be forfeited.

m.   Prizes may not be transferred or exchanged unless otherwise stipulated by the Betting, Gaming and Lotteries Commission.

n.     Digicel reserves the right to award any forfeited prizes to another participant in the Promotion and to substitute Prizes where reasonably required upon consultation and approval of the Betting, Gaming and Lotteries Commission.

o.     Save in the event of its negligence, neither Digicel, nor any other person or party associated with the Promotion, their associated companies, agents, contractors and sponsors or any of its personnel involved in the Promotion, shall be liable whatsoever for any loss or damage incurred or suffered, death or personal injury suffered or sustained, or costs incurred, arising from either participation in the Promotion or from claiming any Reward.

9.       Will customers be notified when they have received a prize?

Yes.

 

 

For Instant Win Prizes:

Customers will be notified via SMS and In App notification for Instant Win Prizes. See below sample confirmation text message.

Sample: “Your FREE <prize> is now active. You have received <XX>MB valid for XX days. Check your prize validity on MDA any time here: pg.mydigicel.net”

            For Daily Cash Prizes:

Customers will be notified via SMS and In App notification as follows:

                            i.        A voucher with a picture of the prize (for illustrative purposes only);

                           ii.        A description of the prize with a QR code; and

                          iii.        A telephone number to contact Digicel to arrange prize collection.  

 

10.     What will customers need in order to claim Daily Cash Prizes?

Winners must present  a valid Government issued photo ID (passport, voters’ identification card or driver’s licence) digitally to jam_recharge@digicelgroup.com and the number of the Digicel Phone on which the prize was won with QR code. Customer will be required to complete and sign a digital Redemption Form confirming their receipt of their prize and authorizing the use of their image on social media and/or any other marketing material associated with this promotion.

Minors under the age of 18 years are eligible for this Promotion but must present a valid school ID or Passport by sending an email to jam_recharge@digicelgroup.com and this should be accompanied by the National Photo ID of a parent or guardian who must also present a National photo ID along with the birth certificate of the said minor when redeeming their prizes by sending to the jam_recharge@digicelgroup.com.

Additional Terms and Conditions

A.    This Promotion is offered for your personal use and not for commercial use and you agree not to sell any rewards redeemed through this Promotion.

B.     We reserve the right to disqualify you or terminate (upon consultation and approval of the Betting, Gaming and Lotteries Commission) this offer if, in our opinion, the Promotion is being abused, such abuse to include but not be limited to selling or attempts to sell the prizes, whether on a commercial basis or otherwise, general abuse deemed as an attempt to undermine the integrity of our services.

C.    You are solely responsible for all associated fees and costs incurred by you for redemption of Daily Cash Prizes and for connectivity and data usage in relation to your use of the App. Be reminded that once roaming, you will not be able to use any data from your local prepaid or select postpaid plans.

D.    The selected winners must have complied with these Terms and Conditions to enter and be on an active, qualifying contract with no accounts held with Digicel being in arrears to be eligible to win the prizes.

E.     We reserve the right to modify or discontinue (permanently or temporarily), this Promotion being offered to you upon consultation and approval of the Betting, Gaming and Lotteries Commission.

F.     If a prize is unavailable, we may, in our discretion, substitute the prize with an alternative prize to the equal value and/or specification with the approval of the Betting, Gaming and Lotteries Commission.

G.   We reserve the right to, at any time, with or without notice, vary or cancel the terms and conditions of this Promotion upon consultation and approval of the Betting, Gaming and Lotteries Commission. In the event of us giving notice to you of any such changes to or cancellation of the Promotion, it shall suffice for us to give you notice via messages to your handset/device or to post such notification on the Digicel website or the App. Any such notification shall be effective immediately or as of the date referred to in such notifications.

H.    Any personal data relating to participants will be used solely for the purposes of this promotion by Digicel and/or by any agent appointed by it to assist with running the promotion on behalf of the Digicel and will not be disclosed to a third party for any other purpose without the individual’s prior consent. By entering this Promotion, you consent to the use of your personal data by Digicel and/or any agent appointed by it to assist with running the promotion for the purposes of administration of the promotion (including publishing your full name and county and/or disclosing it to third parties on request if you are the winner) and any other purposes to which you have consented. I.      Winners may be required to take part in related publicity, including (without limitation) publication of the name and image of a promotion winner along with their winning entry via Digicel’s website, social media and other press and media channels. No additional payment will be given for this.

J.     In addition to these Terms and Conditions, you remain bound by our My Digicel App Terms and Conditions of Use.
