THE “BiP” TERMS AND CONDITIONS

These My Digicel “BiP Promotion” (the “Promotion”) frequently asked Questions (“FAQ”) and Terms and Conditions (the “Terms”) apply to you and govern your participation in the Promotion for chances to win certain prizes on the My Digicel mobile application (the “App”). You should read these FAQs and Terms carefully before participating in the Promotion.

“We” or “us” means Digicel (Jamaica) Limited, a company registered under the laws of Jamaica with registered office 14 Ocean Boulevard, Kingston, Jamaica. References to “we”, “our” and “us” in these Terms also includes our subsidiaries and affiliates (“Affiliates”) from time to time.

“I” or “You” means the person accessing or using the App to participate in the Promotion (and “my” and “your” shall have the same meaning).

By participating in the Promotion on the App, you agree to be bound by these Terms.

These Terms incorporate the BiP Terms and Conditions which you can access via the App.

If you do not agree to or accept any of these Terms, you should stop participating in the Promotion immediately.

1.    What is the Digicel #ThereWithYou BIP Promotion?

Digicel is offering all postpaid and prepaid customers BiP to BiP messaging on the BiP app with no charging for the associated data use during Promotional Period.

Additionally, Digicel customers with an active Eligible Plan will benefit from BiP to BiP Messaging, voice calls and one-to-one video calling on BIP without depleting their plan data allowance.  (The “Promotion”).

2.    What is BIP?

BiP is the new communications app that brings relevant local content, including news and COVID-19 specific updates, messaging, voice, video calling and much more.

Digicel has partnered with BIP to provide exclusive benefits for Digicel mobile customers, such as this promotion.

3.    Who is eligible to enter the Promotion, “Eligible Customers”?

In order to be eligible to participate in this Promotion, you must be a Digicel prepaid or postpaid customer who downloads BIP on the following smartphone devices with the following operating systems:

·         Android: Android 2.3 onwards and 100MB+ available storage on phone

·         iPhone: iOS 7 onwards and 100MB+ available storage on phone

4.    How do I participate in the Promotion?

In order to participate in the Promotion, Digicel customers simply need to download and install BIP (see ‘How do I get BIP’ in section 5 below).  The features, as described below, will be zero-rated by Digicel automatically for the duration of the Promotional Period at section 8.

5.    How do I get BIP?

To access the App, you may either download the application to your mobile device from Google Play or the App store, create an account on the App and sign in.

You can download on WiFi or using an existing Data Plan.  Note, if you download whilst on a Data Plan it will consume approx. 40MB of your data allowance or prepaid credit at your PAYGO / overage rate.

 

6.    What is the promotional period for the Promotion?

The Promotion is valid from [May 1 2020] 12:01 through to [June 30] 23:59 (the “Promotional Period”).

7.    Which prepaid/postpaid bundles/plans are included in the promotion?

Postpaid Plans

Postpaid customers on a Freedom Plan are considered to be on an Eligible Plan for the purposes of this promotion.

8.    What features are included in the Promotion?

For the duration of the Promotional Period, messages sent by Digicel customers from BIP on their phone to another person on BIP are included in the promotion.  Therefore, Digicel Customers will not consume any data allowance or prepaid credit or incur a PAYGO or overage data charge for data usage associated with these messages.

For Digicel customers with an active Eligible Plan, through the Promotional Period, messages, voice and 1:1 video calls made from BIP are included in the promotion. Therefore, Digicel customers who are on an Eligible plan will not consume any data allowance or prepaid credit or incur PAYGO or overage data charge for data usage associated with these messages.

The details of this offering are set out below:

A Fair Usage Policy (FUP) applies in respect of specified BiP features associated with this promotion.

9.    What features of BiP are excluded from this Promotion?

The features specified below are excluded from this promotion:

·         Group (more than one-to-one) video calling – accessed via messages or call menu;

·         Discover services accessed through the discover menu icon;

·         Games – accessed through the games menu icon;

·         Analytics tool – A small amount of background data is consumed when app is opened.

Customers may access the features excluded listed in this section but shall be charged at the customer‘s existing rate for any data allowance or prepaid credit or PAYGO data charge.

10.  Will I be notified before using a feature not included in the Promotion?

Yes.  You will be notified by an in app message prompt within the BIP app about any service that is not included in the Promotion before you use it and so will only incur additional charges or data use if you choose to proceed.

11.  What is the Fair Usage Policy for this Promotion?

A Fair Use Policy applies to all our products and services to ensure that all our customers are able to access our services. Digicel will maintain and control bandwidth capacity with the intention of providing customers with equal access to our services. This policy is developed in reference to normal usage patterns by our customers utilizing our services for private/non-commercial use.

If the customer’s usage of this application is in our sole discretion deemed excessive and/or unreasonable, the customer may be contacted and advised that their usage is in breach of our Fair Use Policy. If the continued excessive use subsists, we may then request that the customer desist from that course of conduct and to come within our Fair Usage Policy.

If the excessive or unreasonable usage persists, we reserve the right to provide you with notice, that we shall suspend, modify or restrict your use of the service(s) or cancel your access to the service(s).

Additional Terms and Conditions

(All Customers)

A.    This product is offered for your personal use and not for commercial use.

B.    You are solely responsible for all associated fees and costs incurred by you for connectivity and data usage in relation to your use of the App. Be reminded that once roaming, you will not be able to use any data from your local prepaid or select postpaid plans.

C.   We reserve the right to terminate this offer if, in our sole opinion, the promotion is being abused, such abuse to include but not be limited to reselling or attempts to resell the content, whether on a commercial basis or otherwise, general abuse deemed as an attempt to undermine the integrity of our services.

D.   We reserve the right to modify or discontinue (permanently or temporarily), this promotion being offered to you at our discretion.

E.    We reserve the right to, at any time, with or without notice, vary or cancel the terms and conditions of this promotion. In the event of us giving notice to you of any such changes to or cancellation of the Service, it shall suffice for us to give you notice via messages to your handset/device or to post such notification on the Digicel website or the App. Any such notification shall be effective immediately or as of the date referred to in such notifications.

F.    You accept that certain content on the App may not be available in your country or in your preferred language due to contractual licensing restrictions. Please note that content available in your current location may become unavailable to you if you travel to another location in which content is restricted.

G.   Any personal data relating to participants will be used solely for the purposes of this promotion by Digicel and/or by any agent appointed by it to assist with running the promotion on behalf of the Digicel and will not be disclosed to a third party for any other purpose without the individual’s prior consent. By entering this Promotion, you consent to the use of your personal data by Digicel and/or any agent appointed by it to assist with running the promotion for the purposes of administration of the promotion and any other purposes to which you have consented.
