These “More ways to Win Christmas Promotion” (the “Promotion”) frequently asked questions (“FAQs”) and terms and conditions (the “Terms”) apply to you and govern your participation in the Promotion for chances to win certain prizes on the MyDigicel mobile application (the “App”). You should read these FAQs and Terms carefully before participating in the Promotion.

“We” or “us” means Digicel [Haiti] Limited, a company registered under the laws of [Haiti] with registered offices at [151, Angle Avenue Jean Paul 2 et Impasse Duverger, Port au Prince Haiti]. References to “we”, “our” and “us” in these Terms also includes our subsidiaries and affiliates (“Affiliates”) from time to time.

“I” or “You” means the person accessing or using the App to participate in the Promotion (and “my” and “your” shall have the same meaning).

By participating in the Promotion on the App, you agree to be bound by these Terms.

These Terms incorporate the MyDigicel Terms and Conditions and Privacy Policy which you can access via the App.

If you do not agree to or accept any of these Terms, you should stop participating in the Promotion immediately.

 

1. What is the “More Ways to Win Christmas Promotion”?

Digicel is offering its prepaid and postpaid mobile customers the opportunity to participate in the “More Ways to Win Christmas Promotion” subject to these terms and conditions. The Promotion allows you to win prizes by shaking your phone via the Shake It section in the MyDigicel App ( the “App”) This year we are introducing a new way to get a Shake opportunity via the More Ways to Win section on MyDigicel App.

 

 

2. What is the promotional period for the Promotion?

The Promotion is valid from November 18, 2021 to Dec 31 2021

 

 

3. Who is eligible to enter the Promotion (an “Eligible Customer”)?

In order to be eligible for the Promotion, you must be a Digicel customer with an active Digicel prepaid and/or postpaid bundle or plan from the selection of “Eligible Plans” as defined below. This includes customers who activate a new Eligible Plan during the promotional period as well as customers on an existing Eligible Plan.

For customers participating through the More Ways to Win section of the App, you will need an active Digicel prepaid or postpaid number only. This number must be associated with the login credentials of all of the participating apps (DMusic, GoLoud, Loop, PlayGo, Sportsmax, Bip and Billo)

The following customers are excluded from participating in the Promotion:

a. Postpaid Corporate & Business account customers;

b. Families of employees, employees of affiliate companies associated with this promotion;

c. Home & Entertainment only customers; and

d. Postpaid customers with overdue amounts.

4. Which Digicel prepaid/postpaid bundles/plans are included in the Promotion?

The Digicel Prime Bundles and all the plans listed below are eligible for the Promotion (collectively, the “Eligible Plans”).

5.     Will customers be notified when to participate in Promotion?

Yes. During the Promotional Period, on Saturdays and other promotional days as Digicel may choose, customers will be notified about the “Guaranteed Win” shake available. On any other day, when a Customer activates an Eligible Plan, they will also receive a notification that they are eligible for the “More Chances to Win” shake.

 

6.      How does the Promotion work?

For MyDigicel App:

Step 1: To participate in the Promotion, you can do one of the following actions:

a.     Buy a Prime Bundle;

b.     Top up your mobile device;

c.     Pay your Digicel bill

d.     Activate an Eligible Plan (either via the MyDigicel App, via the Digicel website of your country, or by dialling the USSD/UMM code *130 - *500 - *509

e.     Win a Bronze, Silver or Gold badge in our More Ways to win area within MyDigicel App.

Step 2: The Eligible Customer will receive a “Shake It” notification inviting them to participate in the Promotion. The customer then confirms their participation in the Promotion by clicking on the “Shake It” notification and accepting these Terms.

Step 3: Once an Eligible Customer agrees to participate in the promotion and is prompted to “Shake It” that Eligible Customer must shake their phone while in the MyDigicel App to win.

Step 4: The Eligible Customer will receive a notification indicating whether they have won a prize or not. Prizes may or may not be able to be traded or gifted. Prizes that cannot be traded or gifted are automatically applied to the account of the winner. For prizes that are presented in a list of rewards, winners will have twenty-four (24) hours to select one or more of the following options, depending on the prize won:

a.     Redeem – If the winner would like to keep the default prize won, it may be redeemed immediately. If it is not redeemed within the twenty-four (24) hour window, it will be automatically redeemed and applied to the winner’s account.

b.     Trade – If the winner would like to trade the prize for another one, the list is available for the selection of a different available prize.

c.     Gift – If the winner would prefer to give a prize to another person as a gift, they may do so by selecting this option and providing the contact details of that person.

 

7.     How can I get a Shake from the More Ways To Win section on MyDigicel App:

Step 1: Perform the specified challenges in any of the “Prime Bundle Apps” (D’Music, BiP, Billo, GoLoud, PlayGo, Loop, SportsMax). To see the full list of activities you can perform on a Prime Bundle App, please visit the More Ways to Win section of MyDigicel App. These challenges change daily.

Step 2: For each challenge performed, Eligible Customers will receive one (1) point. The points will be awarded almost in real time (within seconds after performed) but it could take up to one (1) hour to be reflected in the More Ways to Win section. Based on the total points accumulated by midnight you will get a Shake the following morning (around 7AM local time) and it will be confirmed via SMS. Check the More Ways to Win section of MyDigicel frequently to see your points standing.

Step 3: Once awarded with a Bronze, Silver or Gold Shake, Eligible Customers can redeem their “Shake It” in a period of twenty-four (24) hours.

Points needed for each Badge: Bronze: 5pts; Silver: 10pts; Gold: 20pts

For customers participating through the More Ways to Win section of the App, you will need an active Digicel prepaid or postpaid number. This number must be associated with the login credentials of all of the participating apps (DMusic, GoLoud, Loop, PlayGo, Sportsmax, Bip and Billo) as well on MyDigicel app.

 

8.     What are the chances of winning when doing a Shake?

The Promotion includes a “Guaranteed Win” (subject to these Terms) on Saturdays and other special promotional days, and “More Chances to Win” on any other day.

a.     Guaranteed Win:  Every Saturday during the Promotional Period, participating Eligible Customers who complete the “Shake It” action in the MyDigicel App must receive a prize.

b.     More Chances to Win: On any other day, Eligible Customers using the MyDigicel App have a 50% chance of winning a prize. Eligible Customers will have twenty-four (24) hours from the date and time of the “Shake It” notification to complete the “Shake It” action in the MyDigicel App for a chance to win a prize.

 

 

9.     Can I participate in the Promotion while roaming?

This Promotion is not accessible while roaming.

 

10.     How many times can I win?

The maximum number of wins per Eligible Customer is one (1) per day.

 

11.     What rewards and prizes can I win?

 

The prize pool consists of Digital Prizes, Discount Prizes and Other Prizes.

 

a.     Digital Prizes: These may or may not be able to be gifted to another person and may be redeemed and used immediately after winning. They are categorized as Bronze, Silver or Gold prizes and include:

a.     Discount Prizes: When an Eligible Customer wins a Discount Prize, the benefit will only apply on the next purchase or renewal of the Eligible Plan that is specific to that particular discount. For example: A discount on a 7-day bundle may not be applied to a 3-day bundle. A winner may have multiple Discount Prizes at the same time if they are for varying Eligible Plans.

b.     Other Prizes: Other Prizes may be included in the prize pool daily with notifications of the same via social media and/or other Digicel communication.

12.      How will Eligible Customers be notified if they have received a prize?

Winners and gift recipients will be notified via SMS, push or in-app notification. A confirmation notification is also sent if the Eligible Customer is unsuccessful.

 

13.     How are Digital Prizes redeemed, traded or gifted?

a.     Digital Prizes will be automatically allocated immediately to winners who choose to redeem. There is no need to activate by USSD code or other activation method.

b.     If a winner chooses to trade one of these rewards for another on the list, the selected reward will also be a Digital Prize.

c.     These prizes are available to be used from the time of allocation (within any specified usage period) and expire as per the validity period of the Eligible Plan.

d.     Digital Prizes that have been redeemed, but not used, will expire and there will be no carry over or refund, except for Shake It Digital Bundles (as per rollover terms).

e.     If the winner chooses to gift a reward to another person, a gift list will be regenerated for a selection to be made and the Digicel phone number of the recipient must be provided. Please note that the recipient may only receive rewards which are compatible with their device and Digicel service. If the recipient is unable to receive the prize, you will be notified. Successful gifted rewards will be automatically allocated to the recipient who will also receive a notification of same. Gifted prizes expire in a 24hr period.

f.      Any usage after the specified usage period or after the reward is depleted, will be billed at the customer’s applicable price plan rates, taken from the main data allowance or charged from the customer’s Digicel credit.

 

14.     Can I activate a Digicel Prime Bundle if I have already redeemed and activated a Digital Prize?

 

Yes. The Digital Prizes, including the Shake It Digital Bundles are all compatible with our other plans and bundles and may be active at the same time. The Shake It Digital Bundles require new dedicated accounts that must be exclusive to them.

 

 

15.     How can I check the balance on my Digital Prizes?

You can check your balance at any time in the MyDigicel App.

 

 

16.     Can my Shake It Digital Bundle rollover?

Yes. Any outstanding data balance at the end of the applicable period will remain valid for the period of the newly activated Eligible Plan. An expired Eligible Plan cannot rollover.

 

 

17.     Can I activate more than one Free International Minutes Plan?

Yes. You may can subscribe to multiple plans for free international minutes.

 

18.     How are Other Prizes redeemed?

a.     Upon winning a prize in this category, the winner will receive a notification including:

(i)     A voucher with a picture of the prize (for illustrative purposes only);

(ii)    A description of the prize with a QR code; and

(iii)  A telephone number to contact Digicel to arrange prize collection.  

(iv)  A coupon number to be redeemed on other participating third party website

b.     Customers MUST contact Digicel on the number provided within 24 hours of the notification being issued or the prize may be forfeited.

c.     Once the winner has contacted Digicel and is validated, their prize will be made available for collection from: [Digicel Turgeau and for the winner outside of PAP , prizes will be available via GM of Region.

d.     Customers are encouraged to collect their prize within two (2) trading days (Monday to Saturday) and are required to collect their prize within fourteen (14) days from the issue date of the notification of the prize win or the prize will be forfeited.

e.     Other Prizes may not be gifted or traded for cash or another product. 

f.      Digicel reserves the right to award any forfeited prizes to another Eligible Customer and to substitute Other Prizes where reasonably required.

g.     Warranty and support information will be included in product packaging.

 

 

19.      What will winners need to present in order to claim Other Prizes?

Winners must present a valid Government issued photo ID (passport, voter’s identification card or driver’s licence) and the phone used to participate in the Promotion with the provided QR code. The winner will be required to complete and sign a redemption form confirming their receipt of the prize and a Consent and Release Form authorizing the use of a picture receiving the prize (where they chose to do so) on Social Media.

 





Additional Terms and Conditions

 

 

A.     This Promotion is offered for your personal use and not for commercial use and you agree not to sell any rewards redeemed through this Promotion.

 

B.     These Terms and Conditions incorporate the Terms and Conditions and the “More Ways to Win” FAQs for D’Music, BiP, Billo, GoLoud, PlayGo, Loop and SportsMax.

 

C.    We reserve the right to disqualify you or terminate this offer if, in our sole opinion, the Promotion is being abused, such abuse to include but not be limited to selling or attempts to sell the prizes, whether on a commercial basis or otherwise, general abuse deemed as an attempt to undermine the integrity of our services.

 

D.    You are solely responsible for all associated fees and costs incurred by you for redemption of Other Prizes and for connectivity and data usage in relation to your use of the App. Be reminded that once roaming, you will not be able to use any data from your local prepaid or select postpaid plans and that if your reward is not an “any use data” award, data usage in any other application except those listed above, will be taken from your main data allowance, your Digicel credit, or billed to your postpaid account.

 

E.     The selected winners must have complied with these Terms and Conditions to enter and be on an active, qualifying contract with no accounts held with Digicel being in arrears to be eligible to win the prizes.

 

F.     We reserve the right to modify, extend or discontinue (permanently or temporarily), this Promotion being offered to you at our discretion.

 

G.    If a prize is unavailable, we may, in our discretion, substitute the prize with an alternative prize of equal value and/or specification.

 

H.    Except where the choice is given to trade, prizes are not exchangeable and are not redeemable for cash.

 

I.      We reserve the right to, at any time, with or without notice, vary or cancel the terms and conditions of this Promotion. In the event of us giving notice to you of any such changes to or cancellation of the Promotion, it shall suffice for us to give you notice via messages to your handset/device or to post such notification on the Digicel website or the App. Any such notification shall be effective immediately or as of the date referred to in such notifications.

 

J.     Any personal data relating to participants will be used solely for the purposes of this promotion by Digicel and/or by any agent appointed by it to assist with running the promotion on behalf of the Digicel and will not be disclosed to a third party for any other purpose without the individual’s prior consent. By entering this Promotion, you consent to the use of your personal data by Digicel and/or any agent appointed by it to assist with running the promotion for the purposes of administration of the promotion (including publishing your full name and county and/or disclosing it to third parties on request if you are the winner) and any other purposes to which you have consented. K.     Winners may share their winnings on their social media platforms and may be required to take part in related publicity, including (without limitation) publication of the name and image of a winner along with their winning entry via Digicel’s website, social media and other press and media channels. No additional payment will be given for this.

 

L.     Except in the event of its negligence, neither Digicel, nor any other person or party associated with the Promotion, their associated companies, agents, contractors and sponsors or any of its personnel involved in the Promotion, shall be liable whatsoever for any loss or damage incurred or suffered, death or personal injury suffered or sustained, or costs incurred, arising from either participation in the Promotion or from claiming any reward.

 

M.    In addition to these Terms and Conditions, you remain bound by our MyDigicel App Terms and Conditions of Use.
