This Digicel “Mother’s Day Smartphone Raffle Promotion” (the “Promotion”) Frequently asked Questions (“FAQs”) and Terms and Conditions (the “Terms”) apply to you and govern your participation in the Promotion for a chance to win the various Grand Prizes offered. You should read these FAQs and Terms carefully before participating in the Promotion.

“We” or “us” means Digicel, a company registered under the laws of Dominica with registered offices at 20 Bath Road, Roseau. References to “we”, “our”, “us” and “Digicel” in these Terms also include our subsidiaries and affiliates (“Affiliates”) from time to time. “I” or “You” means the person participating in the Promotion (and “my” and “your” shall have the same meaning).

By participating in the Promotion, you agree to be bound by these Terms.

These Terms incorporate the “Mother’s Day Smartphone Raffle” promotion Terms and Conditions.

If you do not agree to or accept any of these Terms, or if you are under the age of eighteen (18), you should stop participating in the “Mother’s Day Smartphone Raffle” Promotion immediately.

 

1.  What is the Digicel “Mother’s Day Smartphone Raffle” Promotion”?

a.     We are offering our existing and new prepaid and postpaid customers (subject to Clause 8) the opportunity to participate in our Mother’s Day Smartphone Raffle” promotion. The “Mother’s Day” promotion gives you chances to win, smartphones weekly and the grand prize of a Samsung Galaxy S20 FE.

b.     Every customer activating any Digicel Prime Premium Bundle qualifies for chances to win. Customers joining the Digicel network by purchasing a SIM card or signing up on a Digicel Postpaid Prime Bundle, qualify also.

 

2.   What smartphones are included in weekly draws?

You have chances to win the Samsung A51 smartphone every week until Mother’s Day.

 

 

3.  When does the Promotion start and end?

The Promotion is valid from April 16, 2021 through to 11:59PM May 08, 2021 (the “Promotional Period”). The draw dates will occur on April 24, May 01 and May 09.

 

4.   How will winners be selected?

a.     A customer will be selected at random from the complete list of eligible customers received each week of the Promotional Period and declared, ‘Winner’. Please note that each time you activate a Digicel Prime Premium Bundle, you get an entry on the list, increasing your chances to win weekly and the Grand Prize.

b.     Selection will take place at Digicel’s Office on 20 Bath Road, Roseau.

 

5. How will the Winner be notified?

a.     The Winner will be notified by a Digicel representative who will call the mobile phone number used by the Winner to participate in the Promotion.

b.     If the weekly prizes or Grand Prize is declined, or unclaimed due to Digicel being unable to contact the Winner from the contact details supplied after three (3) attempts (reasonably split over a twenty-four (24) hour period, Digicel reserves the right to withdraw the Grand Prize from the Winner and shall pick a different eligible customer to be the Winner.

 

6.  What do I need to know about claiming the Weekly and Grand Prizes if I am the Winner?

a.     During the telephone call, full details of the weekly and grand prizes handover (redemption) process and location will be confirmed. 

b.     You will need to present a valid photo ID (passport, social security card or driver’s license) and the phone used to participate in the Promotion. 

 

7. Who can participate in the Promotion?

To participate in the Promotion, you must be a Digicel customer who has activated an Eligible Plan (as defined in Clause 8) OR have joined Digicel by purchasing and activating a SIM Card or Digicel Postpaid Prime Bundle during the promotional period. 

The following customers are excluded from participating in the Promotion:

a.     Corporate & business account customers

b.     Any person who, at any time on or after October 1st, 2020, was or is a director, officer, employee, or agent of Digicel or any of their respective parents, subsidiaries, divisions, or affiliated companies, franchisees or service agencies, independent contractors or suppliers of services to Digicel;

c.     Families of our employees;

d.     Employees and families of employees of any company associated with this Promotion, including any provider of the Grand Prizes;

e.     Customers with Digicel+ only;

f.      Postpaid customers with overdue amounts or inactive accounts;

g.     Persons under the age of eighteen (18); and

h.     Persons who do not reside in Dominica.   

 

8. Which Digicel prepaid/postpaid bundles/plans are included in the Promotion?

Please see below list of plans that are eligible for the Promotion (the “Eligible Plans”):

9.  Will I be notified when I participate in the Promotion?

Once you activate a Digicel Prime Bundle, you will receive a message confirming your chance to win in the “Digicel Mother’s Day Raffle” Promotion.

 

If you activate a new SIM Card or sign up for a new Digicel Postpaid Prime Bundle, you will receive confirmation of your entry into the promotion by Digicel sales agents.

 

Additionally, look out for text messages reminding you of the promotion. 

 

 

Additional Terms & Conditions

 

 

A.    This Promotion is offered for your personal use and not for commercial use.

B.     You are required to use a compatible smartphone to run the App and participate in the Promotion. A compatible smartphone is an Android (OS 4.0 or higher) or Apple (iOS 2.0 or higher) smartphone.

C.    We reserve the right to disqualify you or terminate this offer if, in our sole opinion, the Promotion is being abused.

D.    We reserve the right to modify, extend or discontinue (permanently or temporarily), this Promotion being offered to you, at our discretion.

E.     You are solely responsible for all associated fees and costs incurred by you for connectivity and data usage in relation to your use of your Prime Bundles, and your redemption of prizes.

F.     The prizes in this Promotion can only be redeemed in Dominica.

G.   The prizes are non-transferable, and Digicel reserves the right at any time to cancel, modify, or supersede the Promotion due to circumstances outside its control.

H.    Digicel’s decisions, including the selection of a Winner, are final and binding on all participants.

I.      Upon accepting a prize in this Promotion, you will be responsible for reading and accepting any terms and conditions that may be associated with that prize.

J.     Prizes cannot be exchanged for cash.

K.     If a prize is shown to be damaged or defective upon collection, or within seven (7) days from the date of collection, neither due to any fault of the Winner nor as a result of any use or misuse of the Prize after collection, the winner may contact us within that seven (7) day period to report the damage or defect and request a replacement.

L.     If any of the Prizes described above are unavailable, we may, at our discretion, substitute that Grand Prize with an alternative prize of equal value and/or specification. This also applies to replacements where a Prize is found to be damaged or defective.

M.   Participants must have complied with these Terms and Conditions to win.

N.    We reserve the right to, at any time, with or without notice, vary or cancel the terms and conditions of this Promotion. In the event of us giving notice to you of any such changes to or cancellation of the Promotion, it shall suffice for us to give, notice via messages to your handset/device or to post such notification on the Digicel website. Any such notification shall be effective immediately or as of the date referred to in such notifications.

O.   Any personal data relating to participants will be used solely for the purposes of this Promotion by Digicel and/or by any agent appointed by it to assist with running the Promotion on behalf of Digicel and will not be disclosed to a third party for any other purpose without the individual’s prior consent. By entering this Promotion, you consent to the use of your personal data by Digicel and/or any agent appointed by it to assist with running the Promotion for the purposes of administration of the Promotion. This includes publishing your full name and country and/or disclosing it to third parties on request, and any other purposes to, which you have consented, if you are Selected Winner. P.     You agree to take part in any promotional, marketing or publicity activities or events reasonably requested by Digicel.  By participating in the Promotion, you consent to the use of your name, likeness, image, photograph for any and all programming and/or publicity or advertising purposes, commercial or otherwise, in all media and formats used by Digicel’s or its agencies, without further compensation, throughout the world in perpetuity. If you refuse to do so, you forfeit your right to claim the weekly or Grand prizes if you are selected as the Winner.
