Frequently Asked Questions and Terms & Conditions

 

These Frequently Asked Questions (“FAQs”) and Terms and Conditions (the “Terms”) apply to you and govern your participation in the Promotion. You should read these FAQs and Terms carefully before participating.

We” or “us” means Digicel Curacao, a company registered under the laws of Curacao with registered offices at Biesheuvel 24-25.

References to “we”, “our”, “us” and “Digicel” in these Terms also include our subsidiaries and affiliates (“Affiliates”) from time to time.

“I” or “you” means the subscriber of My Digicel App (the “App”) participating in the Promotion (and “my” and “your” shall have the same meaning).

By participating in the Promotion, you agree to be bound by these Terms.

These Terms incorporate the mobile application Terms of Use and Privacy Policy which you can access via the App.

If you do not agree to or accept any of these Terms, or if you are under the age of eighteen (18) you should not participate in the Promotion.

 

1.     What is the Digicel Christmas “Pick & Win and Weekly Raffle & The Grand Draw Raffle” Promotion?                             

As part of our Christmas campaign, the Digicel Christmas “Pick & Win and Weekly Raffle & Grand Draw Raffle” Promotion (the “Promotion”) which allows Customers to Win prizes: My Digicel App (the “App”) users can unlock boxes to win prizes once a qualified activity is completed. Upon plan activation or bill pay customers will also receive tickets to paricipate into our Weekly Raffle and tickets to participate into our Grand Draw Raffle to win even more prizes.

                                                                                                                 

2.     When does the Promotion start and end?

The Promotion starts on November 18, 2022, and ends on January 6th, 2023 (the “Promotional Period”).

 

3. Who is eligible to participate in the Promotion? 

The following persons are elgibile to participate in the Promotion:

a.     Digicel GSM (Mobile) prepaid customers; and

b.     Digicel GSM (Mobile postpaid customers

 

4.     How does the Promotion work?

The Pick and Win promotion will be introduced in the MyDigicel App. Ensure that you have this App installed and have an active subscription. The App can be downloaded in the Google Play Store on Android devices and in the App Store for Apple devices. The weekly and Grand prize draw is available for all customers with a Digicel SIM. Follow the steps below to participate:

 

Pick & Win

Step 1: Complete a Qualified Activity (defined at Question 5).

Step 2: Upon completing a Qualified Activity, you will get instant access to “Pick & Win” in the App.

Step 3: “Pick & Win” in the App by picking the box of your choice. This must be completed on the same day you qualify to “Pick & Win”.

Step 4: Redeem or giveaway your prize.

 

Weekly Raffle and Grand Draw Raffle

 

A.    Prepaid Customers

Step 1: Upon completing a Qualified Activity, you will be given a related amount of tickets to participate into the Weekly Raffle and a related amount of tickets to participate  into the Grand Draw Raffle.

Step 2: Track your tickets in the App.

 

B.    Postpaid Customers

Step 1: Upon completing a Qualified Activity, you will be given a related amount of tickets for each ANG into the Weekly Raffle and a related amount of tickets for each ANG into the Grand Draw Raffle.

Step 2: Track your tickets in the App.

 

5.     What activities qualify me to participate in the “Pick & Win” Promotion, the Weekly and Grand Prize draw?

Exclusions

The following persons may not participate in the Promotion:

a.    Any person who was a winner of a Digicel promotion at any time within the last six (6) calendar months;

b.    Business account customers;

c.     Any person who, at any time on or after February 1, 2022, was or is a director, officer, employee, or agent of any Digicel market or any of their respective parents, subsidiaries, divisions, or affiliated companies, franchisees or service agencies, independent contractors or suppliers of services to any Digicel market;

d.    Families of our employees;

e.    Employees and families of employees of any company associated with this Promotion;

f.      Digicel Postpaid customers with overdue amounts;

g.    Persons under the age of eighteen (18); and

h.    Any person who does not reside in Curaçao.

 

6. What kind of prizes can I win?

Participants can win the following prizes:

Pick & Win winners can win any of the following prizes:

·       1 Day Int. Add-On ( 10 MIN ).

Also, all Pick & Win winners will win a related amount of tickets to participate into both the Weekly Raffle and Grand Draw Raffle.

 

You will receive your raffle ticket immediately in the App.

iv.             Grand Draw Raffle

o   Chance to grab up to $3,000 in the Cash Vault

o   1-night stay and 1-yr postpaid plan

o   1-yr family postpaid plan

 

7. How do I redeem my prize?

A.    Pick & Win

i.                You can redeem your Telco prize immediately in the App.

ii.              You can redeem your tangible prize and/or coupons by following the instructions of the Digicel representative who will contact you.

 

B.    Weekly Raffle and Grand Draw Raffle

You can redeem your prize by following the instructions of the Digicel representative who will contact you.

 

Contact by Digicel representative:

a.    If you win, Digicel will contact you by telephone.

b.    A maximum of three (3) attempts will be made to call you within a period of twenty-four (24) hours.

c.     If you do not answer any of our calls,  annother participant will become the winner.

d.    The above process will be followed until the winner is identified.

e.    During the telephone call, our Digicel representative will advise you where and how to redeem your prize.

f.      You will be required to provide government-issued identification.

g.    You agree that if you are a winner, you will permit photographs of you to be taken and for your image, likeness and name (your “Likeness”) to be used for public relations and marketing purposes free of cost, including the publishing of your Likeness on social media, mainstream media, the App and other platforms that we may choose. If you refuse to do so, you acknowledge that this will result in forfeiture of your right to claim the prize.

 

8. How do I giveaway my prize?

You can giveaway your ‘Pick & Win’ prize to another Digicel customer by selecting the “Gift” option when your gift appears in the App.

 

9. How Will I Be Able To Track/View My Tickets?

Participants will be able to check and monitor their raffle tickets via the App and UMM. 

 

10. Will There Be Guaranteed Win Days Similarly To Shake-It Promotion? 

Guaranteed ‘Win Days’ will be on Wednesdays.

 

11. How Many Times Can I Win? 

 

Pick & Win

Participants will be limited to three (3) wins per day.   

 

Weekly Raffle

Participants can win once (1) weekly. You can win the weekly raffle multiple times throughout the Promotional Period.

 

Grand Draw Raffle      

Participants can only win once (1) during the entire Promotional Period.

   

12. Will My “Pick & Win’ Chances Roll Over If I Don’t Use Them?

No, participants must Pick & Win the same day they qualify. (Until midnight)

 

13. Will There Be A Grand Prize Draw?

Yes, the Grand Draw Raffle day is January 6th, 2023

 

14. Will There Be A Weekly Prize Draw?  

Yes, the Weekly Draw Raffle Day is done every Tuesday. 

 

After each weekly raffle, you will have a renewed chance to qualify to participate in the Promotion by simply following all the steps again as outlined in point 4 above.

16. Will There Still Be A “Shake It” Promotion This 2022 Christmas Season?

For Christmas 2022, Digicel will be replacing the Shake It Promotion with the new “Pick & Win & Raffle” promotion in MyDigicel App.

 

 

Additional Terms and Conditions

A.     This Promotion is offered for your personal use and not for commercial use and you agree not to sell any prizes redeemed through this Promotion.

 

B.     The winner will be required to participate in any planned publicity in connection with this Promotion. By accepting the prize, the winner consents to the use of their name, likeness, images and/or photographs for any and all programming and/or publicity or advertising purposes, commercial or otherwise, in all media and formats used by Digicel or their agencies, without further compensation, throughout the entire world in perpetuity. If the winner refuses to do so, they forfeit their right to claim the prize.

 

C.    Upon accepting a prize, you will be responsible for reading and accepting any terms and conditions that may be associated with that prize.

 

D.    You are required to use a compatible smartphone to run the App and participate in the Promotion. A compatible smartphone is an Android (OS 5.0 or higher) or Apple (iOS 11 or higher) smartphone.

 

E.     We reserve the right to disqualify you or terminate this offer if, in our sole opinion, the Promotion is being abused, such abuse to include but not be limited to selling or attempts to sell the prizes, whether on a commercial basis or otherwise, general abuse deemed as an attempt to undermine the integrity of our services.

 

F.     We reserve the right to modify, extend or discontinue (permanently or temporarily), this Promotion being offered to you, at our discretion.

 

G.    You are solely responsible for all associated fees and costs incurred by you for claiming and collection of prizes and for connectivity and data usage in relation to your use of the App.

 

H.    If a prize is unavailable, we may, at our discretion, substitute the prize with an alternative prize of equal value and/or specification.

 

I.       We reserve the right to award any forfeited prize to the next qualifying participant.

 

J.     Prizes are not exchangeable and are not redeemable for cash unless otherwise specified.

 

K.     We reserve the right to, at any time, with or without notice, vary or cancel the terms and conditions of this Promotion. In the event of us giving notice to you of any such changes to or cancellation of the Promotion, it shall suffice for us to give you notice via messages to your handset/device or to post such notification on the Digicel website or the App. Any such notification shall be effective immediately or as of the date referred to in such notifications.

 

L.     Any personal data relating to you will be used solely for the purposes of this Promotion by Digicel and/or by any agent appointed by us to assist with running the Promotion on our behalf and will not be disclosed to a third party for any other purpose without your prior consent. By entering this Promotion, you consent to the use of your personal data by Digicel and/or any agent appointed by it to assist with running the Promotion for the purposes of administration of the Promotion (including publishing your full name and county and/or disclosing it to third parties on request if you are selected) and any other purposes to which you have consented. M.    Except in the event of its negligence, neither Digicel, nor any other person or party associated with the Promotion, their associated companies, agents, contractors and sponsors or any of its personnel involved in the Promotion, shall be liable whatsoever for any loss or damage incurred or suffered, death or personal injury suffered or sustained, or costs incurred, arising from either participation in the Promotion or from claiming or collecting any prize.
