TERMS AND CONDITIONS

This“Digicel Top-Up and Win” Promotion (the “Promotion”) Frequently asked Questions (“FAQs”) and Terms and Conditions (the “Terms”) apply to you and govern your participation in the Promotion for a chance to win a Grand Prize. You should read these FAQs and Terms carefully before participating in the Promotion.

“We” or “us” means ANTILLIANO POR N.V., T/A DIGICEL BONAIRE, a company registered under the laws of Bonaire with the registered offices at Kaya Grandi 26, Kralendijk, Bonaire, References to “we”, “our” and “us” in these Terms also includes our subsidiaries and affiliates (“Affiliates”) from time to time.

“I” or “You” means the person participating in the Promotion (and “my” and “your” shall have the same meaning).

By participating in the Promotion, you agree to be bound by these Terms.

These Terms incorporate the MyDigicel Terms and Conditions and Privacy Policy which you can access via the App.

If you do not agree to or accept any of these Terms, you should stop participating in the Promotion immediately.

 

1.       What is the “Digicel Top-Up and Win” Promotion?

Digicel is offering all prepaid customers with a LTE handset the opportunity to participate in the “Top-Up and Win” Promotionwhich is subjected to these terms and conditions. This Promotion allows you to WIN double data and a cash prize by topping up with Naf15 or more and activating a 3 day LTE data plan. Each participating customer will have an opportunity to win $2,500 (“Grand Prize”) in the grand drawer raffle. Any tax liability arising from the receipt of the prize will be the responsibility of the recipient.

2.       What is the “Grand Prize”?

The Grand Prize is USD$2,500.

3.         What is the promotional period for the Promotion?

The Promotion is valid fromThursday, March 5th, 2020 only from00:01 through to 23:59on Thursday, April 16th, 2020. The Grand Prize Draw in Curacao on Friday, April 17th, 2020.

 

4.       Who is eligible to enter the Promotion, “Eligible Customers”?

In order to be eligible for the Promotion, you must be a Digicel Prepaid customer and have topped up (recharge) your account with Naf15 or more, and have activate a 3 day LTE data plan during the promotional period.

The following customers are excluded from participating in the Promotion:

a.     Employees/families of employees, employees of affiliates companies associated with this promotion;

b.     Persons under the age of 18.

 

 

5.       Which Digicel prepaid data plan is included in the Promotion?

Please see below list of plans that are eligible for the Promotion (the “Eligible Plans”) in the Participating Market of Bonaire:

·       3 Day 500MB LTE Data Plan

·       3 Day 800MB Data+Talk LTE Bundle

6.       How does a customer participate in the Promotion?

To participate in the Promotion you will need to have an LTE compatible handset, top-up with Naf15 or more and have activated an Eligible (3 Day LTE Data) Plan via one of the following channels:

1.     MyDigicel App; or

2.     USSD/UMM (by dialing *123#).

7.       Will customers be notified when to participate in thePromotion?

Yes.  Whenever a Customer tops up with Naf15 or more, he/she will receive an SMS notification that they are eligible for a Chance to Win.

8.       How will the winner be selected?

The Grand Prize Draw Promotion process:

a.     A qualified customer will be selected at random from the complete listing of eligible customers received during the promotion period (“the Selected Customer”).

b.     There will be one (1) winner.

c.      All qualifying top-up and purchased an eligible data plan during the Promotional Period can be submitted until 23:59 GMT on Thursday, April 16th, 2020(“Closing time”).

d.     Selection will take place at the DigicelCuracao Head Office onFriday, April 17th, 2020.

e.     Digicel accepts no responsibility for any failure to have participated in the Promotion by the Closing Time, including but not limited to, any delayed activations for any reason.

9.       How will the winner be notified?

a.       The Selected Customer will be notified by a Digicel Representative calling the mobile phone number used by the Selected Customer to participate in the Promotion.

b.      If the prize is declined or unclaimed as the Selected Customer cannot be contacted from the details supplied on their submission after three (3) phone call attempts (reasonably split over a twenty-four (24) hour period) or if the Selected Customer does not present per Clause 8, Digicel reserves the right to re-draw another Eligible Customer at random.

c.       The prize is nontransferable and Digicel reserves the right at any time to cancel, modify, or supersede the Promotion due to circumstances outside its control.

d.      Digicel’s decision is final and binding on all participants.

10.   What will the selected customer need in order to claim the Grand Prize?

During the telephone contact of the Selected Customer, full details of the prize handover (redemption) process and location will be confirmed.  The customer will need to present a valid Government issued photo ID (passport, voters’ identification card or driver’s licence) and bring the phone used to participate in the Promotion.  The customer will be required to complete and sign a Redemption Form confirming their receipt of their prize and/or a Consent Release Form authorizing the use of their name and picture for marketing purposes as per the additional Terms and Conditions.

Additional Terms and Conditions

A.     This Promotion is offered for your personal use and not for commercial use.

B.     We reserve the right to disqualify you or terminate this offer if, in our sole opinion, the Promotion is being abused.

C.     You are solely responsible for all associated fees and costs incurred by you for redemption of the prize, including but not limited to Withholding Tax or any other ‘winning’ tax.

D.     We reserve the right to modify or discontinue (permanently or temporarily), this Promotion being offered to you at our discretion.

E.      We reserve the right to, at any time, with or without notice, vary or cancel the terms and conditions of this Promotion. In the event of us giving notice to you of any such changes to or cancellation of the Promotion, it shall suffice for us to give you notice via messages to your handset/device or to post such notification on the Digicel website or the App. Any such notification shall be effective immediately or as of the date referred to in such notifications.

F.      Any personal data relating to participants will be used solely for the purposes of this promotion by Digicel and/or by any agent appointed by it to assist with running the promotion on behalf of Digicel and will not be disclosed to a third party for any other purpose without the individual’s prior consent. By entering this Promotion, you consent to the use of your personal data by Digicel and/or any agent appointed by it to assist with running the promotion for the purposes of administration of the promotion (including publishing your full name and county and/or disclosing it to third parties on request if you are the winner) and any other purposes to which you have consented. G.    All entrants agree to take part in any promotional, marketing or publicity activities or events reasonably requested by Digicel.  By participating in the Promotion, entrants consent to the use of their name, likeness, image, photograph for any and all programming and/or publicity or advertising purposes, commercial or otherwise, in all media and formats used by Digicel’s or its agencies, without further compensation, throughout the entire world in perpetuity. If a winner refuses to do so, they forfeit their right to claim the prize. 

H.     In addition to these Terms and Conditions, you remain bound by our My Digicel App Terms and Conditions of Use.
