TERMS AND CONDITIONS

 

Digicel Youth Cricket Series

 

1.    The Digicel Youth Cricket Series (hereafter referred to as “Youth Cricket Series”), is a Programme where all persons, with a valid email address will have the opportunity to vote on Digicel’s designated websites for a High School registered with the Ministry of Education from Jamaica, Barbados, Saint Kitts & Nevis, Guyana, Trinidad & Tobago and St. Lucia (hereafter “Eligible Markets”). The High Schools from each Eligible Market with the most votes per student population will be selected to have sixty (60) of its students participate in a full coaching session hosted by a designated CPL Brand Ambassador for each Eligible Market.

 

2.    High Schools eligible for selection in Youth Cricket Series must be registered with the relevant Ministry of Education (hereafter “Registered High Schools”) and located in one of the Eligible Markets.

 

Eligible Voters

3.    All persons from any jurisdiction with a valid email address assigned to their name (hereafter “Eligible Voters”) will be allowed to vote for any Registered High School of their choice from any Eligible Market during the Voting Period.

 

Voting Period

 

4.    Eligible Voters will have from 12:01am April 16, 2018 to 11:59pm May 14, 2018 (hereafter the “Voting Period”) to vote for a Registered High School in any Eligible Market. Eligible Voters who wish to vote will be required to register their vote by entering a valid email address on any Eligible Market’s Digicel Website [for example https://www.digicelgroup.com/jm or https://www.digicelgroup.com/tt and then by selecting a Registered High School from the list of Registered High Schools set out on an Eligible Market’s Website.

 

Voting Period

12:01 a.m. April 16, 2018 - 11:59 p.m. May 14, 2018

 

 

 

 

Winning High Schools

5.    The Registered High School from each of the six (6) Eligible Markets with the most votes per student population (the “Winning High Schools”) will be selected to participate in Youth Cricket Series.

 

6.    Each Winning High School will be allocated sixty (60) students per school to participate in a full coaching session to be hosted by a designated CPL Brand Ambassador for the respective Eligible Market with supporting coaches from each Eligible Market. The Winning High School in each Eligible Market will be given One (1) coaching session per Eligible Market.

 

7.    The Winning High School’s administration will be responsible for selecting the sixty (60) students to take part in the coaching session by the designated CPL Brand Ambassadors. The School’s administration will select its sixty (60) students by any means it deems appropriate. Digicel assumes no responsibility in relation to the Winning High Schools selection process of its students for participation in the coaching session or any subsequent participation in the Youth Cricket Series. For the avoidance of doubt, Digicel will not be responsible for the Winnings High Schools selection process and a Winning High School being selected to take part in a coaching session is no guarantee that any particular student from that school will be selected to participate in the coaching session.

 

8.    The Winning High School for each Eligible Market will be announced via Social Media, Press Release and on Digicel’s Websites on May 16, 2018.

9.    Brand Ambassadors for each Eligible Market are as follows:

10. For the avoidance of doubt all Brand Ambassadors are subject to change at any time by Digicel without notice for any reason and no Winning High School will have any right to a specific Ambassador.

 

Acceptance of Selection

11. The Winning High Schools from each Eligible Market must accept in writing their selection to take part in Youth Cricket Series within seven (7) days of the announcement of the Winning High Schools. The Winning High School must also provide in their acceptance letter the list of the sixty (60) students it selects to participate in the coaching session along with Digicel’s student “Release Form” provided on the website and signed by all selected students age 18 years or older or parents/legal guardians of students below the age of 18. In the event a Winning High School is unable to accept or does not wish to have its students participate in Youth Cricket Series, the High School with the next highest votes per student population in that Eligible Market will be selected to participate in Youth Cricket Series.

12. Winning High Schools cannot transfer or assign their selection in Youth Cricket Series. Where a Winning High School does not have sixty (60) students to participate in the coaching session the remaining student allotment will be selected from the High School with the second highest votes per student population in that Eligible Market. The High School with the second highest votes per student population in these circumstances must also provide an acceptance letter listing the students it selects to participate in the coaching session for its student allotment along with Digicel’s student “Release Form” provided on the website and signed by all selected students age 18 years or older or parents/legal guardians of students below the age of 18.

 

Digicel’s use of personal data and contact information:

 

13. For any personal data collected by and through the websites administered by Digicel, the Digicel Online Privacy Statement will apply. Digicel may offer additional services, which could include the collection of your personal data pursuant to these terms and conditions and solely for the purposes explained at time of collection. This personal data will not be used for any purposes other than for which they were collected (including, for example marketing purposes). Voters and Participants in Youth Cricket Series acknowledge that Digicel may transfer the personal data collected to countries other than the country in which the information was originally collected. Further, that personal data may also need to be shared with third parties in order to provide any services offered in connection with Youth Cricket Series.

 

Risk of injury during coaching sessions and Youth Cricket Series

 

14. All students and schools participating in the coaching sessions acknowledge that the coaching session involved in the promotion is a recreational endeavour involving physical activity and participation may involve an assumption of risk, which may result in personal injury, death or property damage. Students who are selected by their Winning High School for the coaching session undertake that they are aware of all of the risks involved, including those risks associated with any health condition they may have and entrants further agree and undertake any such risk voluntarily and at their own risk.

 

15. Selected students and/or their parents and/or their Winning High Schools acknowledge and agree that they will, disclose any pre-existing medical or other condition that may affect the risk that either the student or any other person will suffer injury, loss or damage during a coaching session or participation in any further events associated with the promotion.

 

Promotions and/or Image Rights

 

16. Winning High Schools and/or selected students participating in Youth Cricket Series will be required to participate in any planned publicity in connection with Youth Cricket Series. By accepting their involvement in the programme the Winning High School and its selected students consent to the use of their name, likeness, image, photograph for any and all programming and/or publicity promotion or advertising purposes, commercial or otherwise, in all media and formats used by us or our agencies, without further compensation, throughout the entire world in perpetuity. If a Winning High School or selected student refuses to do so, they forfeit their right to participate in Youth Cricket Series.

 

17. In the event a winning High School chooses not to accept the offer or refuses to participate in any promotional activity, they will forfeit their right to participate in Youth Cricket Series and the High School with the second highest votes per student population in the Eligible Market will be selected for participation.

 

Variation

 

18. Digicel, reserves the right to at any time to vary the terms of Youth Cricket Series, to amend its Terms and Conditions, or to withdraw Youth Cricket Series. In any of these events, notice will be given via media advertisements or messages to participants and will be effective immediately or as of the date referred to in such notifications.

 

Liabilities

19. To the extent permitted by law, Digicel excludes all liability for loss, damage or injury of any nature howsoever caused, sustained by any participant under this Programme.

Cancellation

20. Digicel, reserves the right to terminate, cancel, suspend and/or modify Youth Cricket Series if any fraud, virus or other technical problem corrupts the administration, security, safety or proper play of the programme. In such event, Digicel reserves the right (but not the obligation) to award none or any other prizes it deems fit.
