These Frequently Asked Questions (FAQs) and Terms and Conditions (the “Terms”) apply to Digicel’s MOTHER’S DAY PROMOTION We encourage You to carefully review these FAQs and Terms before purchasing a device under this offer.

SUMMARY

1.      DEFINITIONS AND INTERPRETATION

In these Promotional Terms and Conditions (“Terms”):

1.1.  “Digicel” means Digicel Barbados Limited.  

1.2.  “Group” means Digicel and its affiliates, subsidiaries, and related entities.

1.3.  “Participants” or “You” means you, or any individual attempting to participate in this promotion and can include persons who are not Participants of Digicel.

1.4.  “Promotion” means the offer described in Clause 3.

1.5.  “Promotion Period” means the period outlined in Clause 3.3

1.6.  “Qualifying Plan(s)” means the following postpaid plans:

1.6.1.     Oistins Lite ($100 Plan);

1.6.2.     Hastings Flex ($125 Plan);

1.6.3.     Botanical Prime ($220 Plan); or

1.6.4.     Holetown Connect ($330 Plan)

1.7.  “Device(s)” means a Samsung S25 device offered under this Promotion.

1.8.  “Commitment Period” means a minimum period of twelve (12) months from activation of the Qualifying Plan.

2.      ELIGIBILITY

2.1.  This Promotion is available to Participants who:

2.1.1.     sign up for one of the Qualifying Plans during the Promotion Period; and

2.1.2.     successfully complete all onboarding, registration, credit, and verification requirements of Digicel.

2.2.  The Promotion is subject to credit approval, service availability, and device availability.

3.      PROMOTIONAL OFFER

3.1. Details of the Offer

3.1.1.     Participants who sign up for and activate a Qualifying Plan will be able to purchase a Samsung S25 at a discounted price of BBD $1,000.00.

3.1.2.     Allocation shall be determined on a first-come, first-served basis and based on successful activation and confirmation by Digicel.

3.1.3.     Participants must pay the discounted price for the Device upfront and in full. For the avoidance of doubt, there are no financing options available for the Device.

3.2.  Promotional Period

3.2.1.     The promotion shall be live during the dates and times below:

3.3.  The Promotion shall be available at all Digicel stores.

4.      COMMITMENT AND BILLING

4.1.  Participants must maintain the Qualifying Plan for the full Commitment Period.

4.2.  Standard monthly recurring charges, taxes, fees, and any applicable usage charges shall apply in accordance with the Participant Agreement.

5.      DEVICE TERMS

5.1.  Devices are subject to availability while stocks last.

5.2.  Digicel reserves the right to but is not obligated to substitute Devices with similar models of equal or greater value at our sole discretion.

5.3.  Risk in the Device immediately passes to the Participant upon receipt and activation of the Qualifying Plan.

5.4.  Manufacturer warranties shall apply to all Devices and Digicel provides no additional warranties except as required by law.

6.      EARLY TERMINATION AND CLAWBACK

6.1.  If a Participant:
(a) terminates the Qualifying Plan before the end of the Commitment Period;
(b) downgrades to a non-qualifying plan before the end of the Commitment Period; or
(c) is suspended or disconnected due to breach of these terms or any other Digicel terms and conditions, Digicel reserves the right to:

                                i.            charge an early termination fee;

                              ii.            forfeit any deposit paid;

                            iii.            recover the full retail value (or pro-rated value) of any Device provided under this Promotion; and/or

                             iv.            apply any outstanding charges to the Participant’s account immediately.

7.      LIMITATIONS AND EXCLUSIONS

7.1.  Any Devices, prizes, rewards or benefits under the Promotion:
(a) are non-transferable; and
(b) are not redeemable for cash or credit of any kind.

7.2.  Participants shall be eligible to receive the benefit of this Promotion once only during the Promotion Period.

7.3.  For the avoidance of doubt, a Participant shall not be entitled to receive the Promotion more than once, whether through:
(a) multiple accounts;
(b) accounts held individually or jointly; or
(c) any combination of accounts associated with the same Participants.

7.4.  Digicel reserves the right to determine, in its sole discretion, whether multiple accounts are associated with the same Participant, including where accounts share common identifiers such as name, contact details, identification information, billing details, or address.

7.5.  Where a Participant is found to have received or attempted to receive multiple benefits in breach of this clause, Digicel reserves the right to:

a)      refuse to grant additional benefits;

b)     withdraw or reverse any improperly granted benefits; and/or

c)      recover the value of any benefits already applied.

8.      FRAUD, MISUSE, AND DISQUALIFICATION

8.1.  Digicel reserves the right to disqualify any Participant who:
(a) provides false or misleading information;
(b) attempts to manipulate or abuse the Promotion; or
(c) breaches any applicable agreement.

8.2.  In such cases, Digicel may recover any benefits granted, or suspend the Participant’s Digicel account.

9.      AMENDMENT AND WITHDRAWAL

9.1.  Digicel reserves the right to modify, suspend, or withdraw the Promotion at any time. In the event of Digicel giving notice to You of any such changes to or cancellation of the Promotion, it shall suffice for us to give You notice via messages to Your handset/device or to post such notification on the Digicel website or the App. Any such notification shall be effective immediately or as of the date referred to in such notifications.

9.2.  Any such changes shall not affect Participants who have already qualified for and been granted the Promotion, except where required by law or in cases of fraud or error.

10. LIABILITY

10.1.                   To the maximum extent permitted by law, Digicel shall not be liable for:
(a) any indirect, incidental, or consequential loss suffered by Participants participating in this Promotion; or
(b) delays or failure in performance due to events beyond its reasonable control.

10.2.                   To the fullest extent permitted by applicable law, the total and aggregate liability of Digicel arising out of or in connection with this Promotion, whether in contract, tort (including negligence), strict liability, or otherwise, shall be strictly limited to an amount equal to the value of the Qualifying Plan chosen by the Participant under this Promotion. The participant’s sole and exclusive remedy in respect of any claim, loss, or damage arising out of or in connection with the Promotion shall be a refund of such amount.

10.3.                   Participants participate in this Promotion voluntarily and at their own expense and risk and Digicel shall not be liable for any

11. DATA PROTECTION

11.1.                   The Participant’s personal data will be processed in accordance with Digicel’s Privacy Policy and applicable data protection laws.

11.2.                   Any personal data relating to Participants will be used solely for the purposes of this Promotion by Digicel and/or by any agent appointed by it to assist with running the Promotion on behalf of the Digicel and will not be disclosed to a third party for any other purpose without the individual’s prior consent. By entering this Promotion, You consent to the use of Your personal data by Digicel and/or any agent appointed by it to assist with running the Promotion for the purposes of administration of the Promotion (including publishing Your full name and county and/or disclosing it to third parties on request if You are the winner) and any other purposes to which You have consented. 12. GOVERNING TERMS AND LAW

12.1.                   These Terms shall be read together with Digicel ’s standard Participant terms and conditions, which shall prevail in the event of inconsistency.

12.2.                   These Terms shall be governed by and construed in accordance with the laws of Barbados.  

13. GENERAL

13.1.                   If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

13.2.                   No failure or delay by Digicel in exercising any right shall constitute a waiver of that right.

13.3.                   Any dispute, controversy, or claim arising out of or in connection with this Promotion or these Terms (a “Dispute”) shall first be referred to Digicel ’s Participant care team for good faith resolution.
