These Digicel “Valentine’s Day Shake to Win” Promotion (the “Promotion”) Frequently asked Questions (“FAQs”) and Terms and Conditions (the “Terms”) apply to you and govern your participation in the Promotion for a chance to win the Grand Prize. You should read these FAQs and Terms carefully before participating in the Promotion.

 

“We” or “us” NEW MILLENNIUM TELECOM SERVICES N.V., trading as

 DIGICEL ARUBA, a company incorporated in Aruba, having its registered office at L.G. Smith Boulevard 60, Oranjestad, Aruba. References to “we”, “our” and “us” in these Terms also includes our subsidiaries and affiliates (“Affiliates”) from time to time. References to “we”, “our”, “us” and “Digicel” in these Terms also include our subsidiaries and affiliates (“Affiliates”) from time to time. “I” or “You” means the person participating in the Promotion (and “my” and “your” shall have the same meaning).

 

By participating in the Promotion, you agree to be bound by these Terms.

 

These Terms incorporate the “Shake to Win” promotion and My Digicel App Terms and Conditions and Privacy Policy, which you can access via the My Digicel App (the “App”) and https://www.digicelgroup.com/aw/en.html.

If you do not agree to or accept any of these Terms, or if you are under the age of eighteen (18), you should stop participating in the Promotion and the “Shake to Win” promotion immediately.

 

1. What is the Digicel “Valentine’s Day Shake to Win” Promotion?

We are offering our prepaid and postpaid customers (subject to Clause 4) the opportunity to participate in our game of chance known as the Digicel “Valentine’s Day Shake to Win” Promotion subject to these terms and conditions. The “Shake to Win” promotion allows you to win prizes by shaking your phone via the ‘Shake It’ gaming mechanism in the My Digicel App. Each winner of a Telco prize in the “Shake to Win” promotion will be entered for a chance to win a Diamond Ring (“Grand Prize”). Any tax liability arising from the receipt of the Grand Prize will be the responsibility of the recipient.

 

2. What is the Grand Prize?

The Grand Prize is one (1) diamond ring, valued at USD$2,500.00 and Day Pass at Ritz Carlton (“Grand Prize”).

 

3. When does the Promotion start and end?

The Promotion is valid from 00:00 January 28, 2021 through to 23:59 February 14, 2021 (the “Promotional Period”). The Grand Prize draw will take place in Aruba on February 15, 2021.

 

4. Who can participate in the Promotion?

To participate in the Promotion, you must be a Digicel customer with an active Eligible Plan (as defined in Clause 5) from Aruba AND have won a Telco prize in the “Shake to Win” promotion in the My Digicel App.  You may activate a new Eligible Plan during the Promotional Period or already be on an existing Eligible Plan.

The following customers are excluded from participating in the Promotion:

    a.     Postpaid corporate & business account customers;

    b.     Any person who, at any time on or after August 1st, 2020, was or is a director, officer, employee, or agent of Digicel Aruba or any of their respective parents, subsidiaries, divisions, or affiliated companies, franchisees or service agencies, independent contractors or suppliers of services to Digicel Aruba;

    c.      Families of our employees;

    d.     Employees and families of employees of any company associated with this Promotion, including any provider of the Grand Prize;

    e.     Customers with Digicel+ only;

    f.      Postpaid customers with overdue amounts or inactive accounts;

    g.     Persons under the age of eighteen (18); and

    h.      Persons who do not reside in Aruba.

 

5.  Which Digicel prepaid/postpaid bundles/plans are included in the Promotion?

The Eligible Plans will be available in the ‘Shake It’ section of the App, which are identified with the ‘Shake It’ Icon. 

 

1. How do I participate in the Promotion?

    i.   To participate in the Promotion, you will need to have activated an Eligible Plan via one of the following channels:

        1.   My Digicel App; or

        2.  USSD/UMM (by dialing *123#)

    ii.         You will receive a ‘Shake It’ notification inviting you to participate in the “Shake to Win” promotion. The notification will be received via SMS, push and/or an in-app notification.

    iii.  Confirm your participation in the Promotion by clicking on the ‘Shake It’ notification and accepting the terms and conditions.

    iv.        Once you agree to participate in the Promotion, you can then ‘Shake to Win’! Please note the ‘Shake It’ action must be completed in the App.

    v.         If you are a winner of a Telco prize in our “Shake to Win” promotion, you will automatically receive one (1) entry in the “Valentine’s Day Shake to Win” promotion for a chance to win the Grand Prize.

 

2.  Will I be notified when to participate in the Promotion?

As a participant in the “Shake to Win” promotion, whenever you activate an Eligible Plan, you will receive an SMS notification that you are eligible for a chance to win. If you are the winner of a Telco prize, we will also notify you that you have been entered for a chance to win the Grand Prize.

 

3. How will the winner be selected?

    a. A customer will be selected at random from the complete list of eligible customers received during the Promotion Period (the “Winner”).

    b. There will be one (1) Winner.

    c. You may ‘Shake to Win’ until 23:59 on Sunday, February 14, 2021 (“Closing Time”).

    d. Selection will take place at Aruba on February 15, 2021.

    e.  Digicel accepts no responsibility for any failure by any customer to have participated in the Promotion by the Closing Time, including but not limited to, any delayed attempts to ‘Shake to Win’, for any reason.

 

4.  How will the Winner be notified?

    a. The Winner will be notified by a Digicel representative who will call the mobile phone number used by the Winner to participate in the Promotion.

    b. If the Grand Prize is declined, or unclaimed due to Digicel being unable to contact the Winner from the contact details supplied after three (3) attempts (reasonably split over a twenty-four (24) hour period, Digicel reserves the right to withdraw the Grand Prize from the Winner and shall pick a different eligible customer to be the Winner following the process as set out under Clause 8 above.

 

5.  What do I need to know about claiming the Grand Prize if I am the Winner?

    a.  During the telephone call, full details of the Grand Prize handover (redemption) process and location will be confirmed. 

    b.  You will need to present a valid Government issued photo ID (passport, voter’s identification card or driver’s licence) and the phone used to participate in the Promotion. 

    c.   You will be required to complete and sign a Redemption Form confirming receipt of the Grand Prize and/or a Consent Release Form authorizing the use of your name and picture for marketing purposes as per the additional Terms and Conditions.

 

Additional Terms and Conditions

 

A. This Promotion is offered for your personal use and not for commercial use.

 

B. You are required to use a compatible smartphone to run the App and participate in the Promotion. A compatible smartphone is an Android (OS 4.0 or higher) or Apple (iOS 2.0 or higher) smartphone.

 

C. We reserve the right to disqualify you or terminate this offer if, in our sole opinion, the Promotion is being abused.

 

D. We reserve the right to modify, extend or discontinue (permanently or temporarily), this Promotion being offered to you, at our discretion.

 

E. You are solely responsible for all associated fees and costs incurred by you for connectivity and data usage in relation to your use of the App, and your redemption of the Grand Prize, including but not limited to Withholding Tax or any other applicable tax.

 

F. This Promotion will be accessible to you while roaming, but the Grand Prize may only be able to be redeemed in Curacao.

 

G. The Grand Prize is non-transferable, and Digicel reserves the right at any time to cancel, modify, or supersede the Promotion due to circumstances outside its control.

 

H. Digicel’s decisions, including the selection of a Winner, are final and binding on all participants.

 

I. Upon accepting the Grand Prize, you accept KRK Corporation B.V.s Terms and Conditions associated with the Grand Prize, established in Kralendijk, Bonaireand release us from any liability owing to defect or damage caused by or to the Grand Prize.

 

J. Please note the Grand Prize cannot be exchanged for cash. In terms of sizing requirements, where we can, we will first look to resize the Grand Prize, if necessary, and where there is no solution to size requirements, we will offer a replacement of equal or similar value and/or specification.

 

K. Participants must have complied with these Terms and Conditions to win.

 

L. We reserve the right to, at any time, with or without notice, vary or cancel the terms and conditions of this Promotion. In the event of us giving notice to you of any such changes to or cancellation of the Promotion, it shall suffice for us to give you notice via messages to your handset/device or to post such notification on the Digicel website or the App. Any such notification shall be effective immediately or as of the date referred to in such notifications.

 

M. Any personal data relating to participants will be used solely for the purposes of this Promotion by Digicel and/or by any agent appointed by it to assist with running the Promotion on behalf of Digicel and will not be disclosed to a third party for any other purpose without the individual’s prior consent. By entering this Promotion, you consent to the use of your personal data by Digicel and/or any agent appointed by it to assist with running the Promotion for the purposes of administration of the Promotion (including publishing your full name and country and/or disclosing it to third parties on request if you are the Selected Customer) and any other purposes to, which you have consented. N. You agree to take part in any promotional, marketing or publicity activities or events reasonably requested by Digicel.  By participating in the Promotion, you consent to the use of your name, likeness, image, photograph for any and all programming and/or publicity or advertising purposes, commercial or otherwise, in all media and formats used by Digicel’s or its agencies, without further compensation, throughout the world in perpetuity. If you refuse to do so, you forfeit your right to claim the Grand Prize if you are selected as the Winner.

 

O. In addition to these Terms and Conditions, you remain bound by our My Digicel App Terms and Conditions of Use.
