 Terms and Conditions

These “More Shakin’ with Digicel this Carnival” promotion (“Promotion”) terms and conditions (“Terms”) apply to you and govern your participation in the Promotion for chances to win certain prizes on the My Digicel mobile application (“App”). You should read these Terms carefully before participating in the Promotion.

“We” or “us” means Digicel Group Limited, a company registered under the laws of Aruba with registered offices at Clarendon House, 2 Church Street, Hamilton HM11, Bermuda. References to “we”, “our” and “us” in these Terms also includes our subsidiaries and affiliates (“Affiliates”) from time to time including NEW MILLENNIUM TELECOM SERVICES N.V., T/A DIGICEL ARUBA,, a company registered under the laws of Aruba with its registered office at at L.G. Smith Boulevard 60, Oranjestad, Aruba.

“I” or “You” means the person participating in, accessing or using the App to participate in the Promotion (and “my” and “your” shall have the same meaning).

By participating in the Promotion on the App, you agree to be bound by these Terms.

These Terms incorporate the MyDigicel App Terms and Conditions and Privacy Policy which you can access via the App or Digicel Aruba website.

If you do not agree to or accept any of these Terms, you should stop participating in the Promotion immediately.

1.    What is the “More Shakin’ with Digicel this Carnival” promotion?

  • Digicel is offering its prepaid and postpaid mobile customers the opportunity to participate in the “More Shakin’ with Digicel This Carnival” promotion, subject to these terms and conditions. This Promotion allows you, as a mobile customer, to win prizes by shaking your phone via the Shake to Win gaming mechanism in the My Digicel App during the Promotional Period.
  • Each participating mobile customer can win daily and weekly prizes

2.       What is the promotional period for this Promotion?

  • This Promotion is valid for the period from 12:00 a.m. on Wednesday, 15th January, 2020 to 11:59 p.m. on Tuesday, 25th February, 2020 (“Promotional Period”).

3.       Who is eligible to enter this Promotion?

  • In order to be eligible for this Promotion (“Eligible Customer”):
    • You must be a legal resident of  Aruba;
    • You must be 18 years of age or older;
    • You must be an active Digicel mobile customer (either prepaid or postpaid); and
    • If you are a Digicel postpaid mobile customer customer, your account must be in good standing.

Persons in any of the following categories are NOT eligible to participate in this Promotion or win any of the prizes:

  • Any person who at any time on or after 17th January, 2020 was or is a director, officer, employee, agent of Digicel (Aruba) or any of their respective parent, subsidiary, or other affiliated companies, franchisees or service agencies or independent contractors
  • Individuals engaged in the development, production, advertising or distribution of materials for this Promotion (collectively the ”Promotional Entities”); and
  • Persons who are or purport to be immediate family members (defined as biological parent, step-mother, step-father, sister, brother, daughter, son or dependent or spouse of any of the foregoing) of any person in any of the preceding categories, regardless of where they live, or who reside in the same household as any person in any of the preceding categories (i.e., who have lived in the same household for at least three (3) of the twelve (12) months preceding 17th January, 2020 whether those persons are related or not).
  • Digicel Corporate customers are excluded from participating in this Promotion.

4.       How do I qualify for a chance to win a prize in this Promotion?


  • In order to qualify for a chance to win the Grand Prize in this Promotion, you must be an active Prepaid or Postpaid Digicel mobile customer.  

Once you are an active mobile customer, you will qualify for a shake to win a daily prize, which shake will be available for redemption only for a period of 14 days.

A daily prize may be a Digicel Top Up, Cash, Data or calling minutes

NB: You will only have one shake available to redeem at any point in time. 

5.       How does a Mobile customer participate in this Promotion?

  • To participate in this Promotion, you will need to be an active Digicel mobile customer and have the My Digicel App installed on your smartphone. 
  • Eligible Customers, who qualify for a shake, will receive a Shake to Win notification inviting them to participate in this Promotion. 
  • By clicking on the Shake to Win notification and accepting the terms and conditions of same, you have confirmed your participation in this Promotion. 
  • Once an Eligible Customer agrees to participate in this Promotion, they can then Shake to Win!  
  • Please note the Shake to Win action must be completed in the MyDigicel App. 
  • Once the Eligible Customer has completed the Shake to Win action, they will receive a notification advising of the prize won. 

NB: This Promotion will be accessible to Eligible Customers whilst roaming, but any prizes won will only be available to use and redeem in Aruba

7.       As a mobile customer, will I be notified when to participate in this Promotion if I qualify?

  • Yes.  Every day during the Promotional Period, if you are a mobile customer who qualifies, you will be notified about the Shake being available.

8.       How many times can a mobile customer win a daily prize?

  • The maximum number of daily wins per mobile customer is one (1) per day.

9.       Daily Prizes

  • The daily prizes for qualifying Mobile customers in this Promotion will consist of Instant Win Prizes and Other Prizes, including but not limited to:

“Instant Win Prizes:

  • Data Add On
  • On-Net Minutes
  • International calling Minutes

Instant Win Prizes redemption process and use:

a.    Voice and data prizes will be allocated immediately to Eligible Customers who have won these prizes.

b.    These will be available to use from allocation (within any specified usage period) and will expire within 24 hours

c.     Unused voice prizes allocated will expire and there will be no carry over or refund

d.     Any usage that falls outside the specified usage period or after the bundle is depleted, will be billed at the current applicable rates.

Other Prizes redemption process and use:

a.     On winning a prize in this category, the customer will receive a notification to the phone used for the Shake to Win action including:

                            i.        A voucher with a picture of the prize (for illustrative purposes only);

                           ii.        A description of the prize with a Quick Response (“QR”) confirmation code; and

                          iii.        A telephone number to contact Digicel to arrange prize collection.  

b.     Customers MUST contact Digicel on the number provided within 48 hours of the notification being issued or the prize may be forfeited.

c.      Once the winners have contacted Digicel and their entries validated, their prize will be made available for collection from:

  • L.G. Smith Boulevard 60, Oranjestad, Aruba between the hours of 2:30 p.m. to 5:00 p.m. on Fridays.

d.     Customers are required to collect their prize within fourteen (14) days from the issue date of the notification of the prize win or the prize will be forfeited.

e.     Digicel reserves the right to award any forfeited prizes to another participant in the Promotion and to substitute prizes where reasonably required.

f.      Warranty and support information will be included in product packaging.

10.    Will mobile customers be notified when they have received a prize?

  • Yes.

For Instant Win Prizes:

Customers will be notified via SMS and In App notification for Instant Win Prizes.

For Other Prizes:

Customers will be notified via SMS and In App notification as follows:

                            i.        A voucher with a picture of the prize (for illustrative purposes only);

                           ii.        A description of the prize with a QR confirmation code; and

                          iii.        A telephone number to contact Digicel to arrange prize collection.  

11.     What will mobile customers need in order to claim Other Prizes?

  • Winners must present a valid Government issued photo ID (i.e. passport, national identification card or driver’s licence) to verify that they are the authorized account holder/owner of the Digicel account associated with the selected winning entry before the prize is given to them and the Digicel phone with the QR confirmation code. Customer will be required to complete and sign a Redemption Form confirming their receipt of their prize.

Additional Terms and Conditions

A.    Participants in this Promotion acknowledge that compliance with these Terms including all eligibility requirements is a necessary pre-condition to any of the prizes being awarded to them. For removal of all doubt, participants who have not complied with these Terms are subject to disqualification.

B.     This Promotion is offered for your personal use and not for commercial use and you agree not to sell any prizes redeemed through this Promotion.

C.    We reserve the right to disqualify you or terminate this offer if, in our sole opinion, the Promotion is being abused, such abuse to include but not be limited to selling or attempts to sell the prizes, whether on a commercial basis or otherwise, general abuse deemed as an attempt to undermine the integrity of our services.

D.    Digicel does not warrant that access to or use of the Digicel service will be uninterrupted or free of any of the events stated below, due to the nature of computer and wireless communications. Digicel and the Promotional Entities are not responsible for any problems that may arise, including but not limited to:

  • lost, interrupted, inaccessible or unavailable networks or other connection, availability or accessibility problems arising in connection with or over the course of this Promotion; 
  • communications failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions or hardware or software malfunctions, failures or difficulties; 
  • failure of personal computers and/or software and hardware configurations, any technical malfunctions, failures, or difficulties, printing errors, clerical, typographical or other error in the offering or announcement of the prizes or in the prize  notification documents;
  • for any errors of any kind in connection with this Promotion, whether human, mechanical, clerical, electronic, or technical in nature; or
  • the incorrect or inaccurate capture of information, or the failure to capture any information in connection with the Promotion.

E.     Any attempt by an entrant or other individual to deliberately undermine the legitimate operation of this Promotion, including but not limited to any fraudulent claims, may be a violation of criminal and/or civil laws in the countries where this Promotion is being run. Should such an attempt be made, Digicel reserves the right to seek remedies and damages from any such individual, to the fullest extent permitted by law, including criminal prosecution.

F.     You are solely responsible for all associated fees and costs incurred by you for redemption of Other Prizes and for connectivity and data usage in relation to your use of the App. Be reminded that once roaming, you will not be able to use any data from your local prepaid or select postpaid plans.

G.   The selected winners must have complied with these Terms to enter and be on an active, qualifying contract with no accounts held with Digicel being in arrears to be eligible to win the prizes.

H.    We reserve the right to modify or discontinue (permanently or temporarily) this Promotion being offered to you at our discretion.

I.      If a prize is unavailable, we may, in our discretion, substitute the prize with an alternative prize to the equal value and/or specification.

J.     Prizes are not exchangeable and are not redeemable for cash.

K.     We reserve the right to, at any time, with or without notice, vary or cancel the terms and conditions of this Promotion. In the event of us giving notice to you of any such changes to or cancellation of the Promotion, it shall suffice for us to give you notice via messages to your handset/device or to post such notification on the Digicel Aruba website or the App. Any such notification shall be effective immediately or as of the date referred to in such notifications.

L.     In the event of any conflict with any promotional details contained in these terms and conditions and promotional details contained in point of sale, television and print, advertising, promotional packaging and other promotional media (“Promotional Materials”), the details of this Promotion set forth in these terms and conditions shall prevail.

M.   The invalidity or unenforceability of any provision of these terms and conditions shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these terms and conditions shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Digicel employees are not authorized to waive, modify or amend any provision or provisions of these terms and conditions in any manner whatsoever.

N.    Any personal data relating to participants will be used solely for the purposes of this Promotion by Digicel and/or the Promotional Entities and will not be disclosed to a third party for any other purpose without the individual’s prior consent. By entering this Promotion, you consent to the use of your personal data by Digicel and/or Promotional Entities for the purposes of administration of the Promotion (including publishing your full name and county and/or disclosing it to third parties) and any other purposes to which you have consented. O.   In no event will Digicel be liable for more than the relevant prize available under these Terms.

P.     Save in the event of its negligence, neither Digicel, nor any other person or party associated with the Promotion, their associated companies, agents, contractors and sponsors or any of its personnel involved in the Promotion, shall be liable whatsoever for any loss or damage incurred or suffered, death or personal injury suffered or sustained, or costs incurred, arising from either participation in the Promotion or from claiming any prize.

Q.   All entrants agree to take part in any promotional, marketing or publicity activities or events reasonably requested by Digicel.  By participating in the Promotion, entrants consent to the use of their name, likeness, image, photograph for any and all programming and/or publicity or advertising purposes, commercial or otherwise, in all media and formats used by Digicel, its agencies or its affiliates, without further compensation, throughout the entire world in perpetuity. If a winner refuses to do so, they forfeit their right to claim the prize. 

R.     In addition to these Terms, you remain bound by our My Digicel App Terms and Conditions of Use, the Postpaid Terms and Conditions, the Prepaid Terms and Condition and the Home & Entertainment Terms and Conditions (whichever is applicable)
