The “Digicel Shake to Win Regional Draw” Promotion
TERMS AND CONDITIONS

These “Digicel Shake to Win Regional Draw” Promotion (the “Promotion”) Frequently asked Questions (“FAQs”) and Terms and Conditions (the “Terms”) apply to you and govern your participation in the Promotion for a chance to win a Regional Prize every week. You should read these FAQs and Terms carefully before participating in the Promotion.
“We” or “us” means ANTILLIANO POR N.V., T/A DIGICEL BONAIRE, a company registered under the laws of Bonaire with the registered offices at Kaya Grandi 26, Kralendijk, Bonaire, References to “we”, “our” and “us” in these Terms also includes our subsidiaries and affiliates (“Affiliates”) from time to time.
“I” or “You” means the person participating in the Promotion (and “my” and “your” shall have the same meaning).
By participating in the Promotion, you agree to be bound by these Terms.
If you do not agree to or accept any of these Terms, you should stop participating in the Promotion immediately.
1. What is the “Digicel Shake to Win Regional DrawPromotion”?
Digicel is offering its prepaid and postpaid customers the opportunity to participate in its weekly multi-jurisdictional game of chance known asthe “Digicel RegionalShake to Win Prize”Promotion subject to these terms and conditions. The Promotion provides the chance to WIN a weekly prize (valued atFive Thousand United States Dollars (USD $5,000.00) (“the Prize”). Any tax liability arising from the receipt of the prize will be the responsibility of the recipient.
The Promotion allows you to WIN prizes by shaking your phone via the ‘Shake It’ gaming mechanism in the MyDigicel App. Every participating customer will have a chance to win by using Shake It in the MyDigicel app on a Saturday, with a prize draw taking place every Monday.
2. What is the promotional period for the Promotion?
The Promotion is valid from Saturday, February 15th, 202000:01 through to Saturday, August 15th, 2019 23:59 per the respective time zone for each Participating Market (as defined in Clause 5), (the “Promotional Period”). Digicel reserves the right to change the Promotional Period at any time and will notify same on the Digicel website.
3. Who is eligible to enter the Promotion, (“Eligible Customers”)?
In order to be eligible for the Promotion, you must be a Digicel customer with an active Eligible Plan (as defined in Clause 4) from a Participating Market (as identified in Clause 5)and have shaken your phone via the Shake It mechanism in the MyDigicel App on a Saturday, prior to 23:59per the respective time zone for each Participating Market (the “Closing Time”), during the Promotional Period. This includes customers who activate a new Eligible Plan during the promotional period as well as customers on an existing Eligible Plan.
The following customers are excluded from participating in the Promotion:
a. Postpaid Corporate & Business account customers;
b. Employees/families of employees, employees of affiliates companies associated with this promotion;
c. Home & Entertainment only customers;
d. Postpaid customers with overdue amounts;
e. Persons under the age of 18 years.
4. Which Digicel prepaid/postpaid bundles/plans are included in the Promotion?
Please see below list of plans that are eligible for the Promotion (the “Eligible Plans”) in the Participating Market of Digicel Bonaire.

Eligible Postpaid Freedom plans:
The Eligible Plans for other Participating Markets will be available on the respective market website at www.digicel group.com.Customers can also find the list of eligible plans in the ‘Shake It’ section of the App, which are specifically identified with the ‘Shake It’ Icon.
5. Are all Digicel markets included in this Promotion?
No. Those markets participating (“Participating Markets”) in the Promotion are:
· Antigua and Barbuda;
· British Virgin Islands;
· El Salvador;
· St Kitts & Nevis;
· St Vincent & the Grenadines;
· St. Lucia;
· Trinidad & Tobago; and
· Turks & Caicos Islands.
Digicel reserves the right to change the Participating Markets at any time and will notify same on the Digicel website.
6. How does a customer participate in the Promotion?
i. To participate in the Promotion you will need to have activated an Eligible Plan via one of the following channels:
1. MyDigicel App; or
2. USSD/UMM (by dialing *123#).
ii. EligibleCustomers will receive a ‘Shake It’ notification inviting them to participate in the Promotion.The notification will be received either via SMS push and/or an In-App notification.
iii. By clicking on the ‘Shake It’ notification, and accepting the terms and conditions, the customer has confirmed their participation in the Promotion. (“Participating Customer”);
iv. Once an Eligible Customer agrees to participate in the Promotion, they can then Shake To Win!
v. Please note the ‘Shake It’ action must be completed in the App.
vi. Participating Customers will onlyhave one (1) chance to win each weekly Prize during the Promotional Period from the issue date and time of the ‘Shake It’notification to complete the ‘Shake It’ action.
vii. This Promotion will be accessible to Participating Customers while roaming, but any prizes won will only be available to use and redeem in Bonaire.
7. Will customers be notified when to participate in thePromotion?
· Yes. Whenever a Customer activates an Eligible Plan, they will receive an SMS/In App notification that they are eligible for a Chance to Win.
8. How will the winner be selected?
The Prize Draw Promotion process:
a. A customer will be selected at random from the complete listing of Eligible Customers received during the promotion period (“the Selected Customer”).
b. There will be one (1) winner per Draw per week.
c. Selection will take place at the Digicel Caribbean Limited’sHead Office at in St. Luciaevery Monday until the end of the promotion.
d. Digicel accepts no responsibility for any failure to have participated in the Promotion by the Closing Time, including but not limited to, any delayed activations for any reason.
9. How will winners be notified?
a. The Selected Customer will be notified by a Digicel Representative calling the mobile phone number used by the Selected Customer to participate in the Promotion.
b. If the prize is declined or unclaimed as the Selected Customer cannot be contacted from the details supplied on their submission after three (3) phone call attempts (reasonably split over a twenty-four (24) hour period) or if the Selected Customer does not present per Clause 10, Digicel reserves the right to re-draw another Eligible Customer at random.
c. The prize is nontransferable and Digicel reserves the right at any time to cancel, modify, or supersede the Promotion due to circumstances outside its control.
d. Digicel’s decision is final and binding on all participants.
10. What will the selected customer need in order to claim the Prize?
During the telephone contact of the Selected Customer, full details of the prize handover(redemption) process and location will be confirmed. The customer will need to present a valid Government issued photo ID (passport, voters’ identification card or driver’s licence) and bring the phone used to participate in the Promotion. The customer will be required to complete and sign a Redemption Form confirming their receipt of their prize and/or a Consent Release Form authorizing the use of their name and picture for marketing purposes as per the additional Terms and Conditions.
In the event that a special needs customer is selected and they are unable to collect their prize, that customer will be allowed to have a representative collect the prize on their behalf who must provide: written consent from the winner and valid Government issued photo identification for both the winner and the representative to claim the prize.
Additional Terms and Conditions
A. This Promotion is offered for your personal use and not for commercial use.
B. We reserve the right to disqualify you or terminate this offer if, in our sole opinion, the Promotion is being abused.
C. You are solely responsible for all associated fees and costs incurred by you for redemption of the prize, including but not limited to Withholding Tax or any other ‘winning’ tax.
D. The selected winner must have complied with these Terms and Conditions to enter and be on an active, qualifying contract with no accounts held with Digicel being in arrears to be eligible to win the prize.
E. We reserve the right to modify or discontinue (permanently or temporarily), this Promotion being offered to you at our discretion.
F. We reserve the right to, at any time, with or without notice, vary or cancel the terms and conditions of this Promotion. In the event of us giving notice to you of any such changes to or cancellation of the Promotion, it shall suffice for us to give you notice via messages to your handset/device or to post such notification on the Digicel website or the App. Any such notification shall be effective immediately or as of the date referred to in such notifications.
H. All entrants agree to take part in any promotional, marketing or publicity activities or events reasonably requested by Digicel. By participating in the Promotion, entrants consent to the use of their name, likeness, image, photograph for any and all programming and/or publicity or advertising purposes, commercial or otherwise, in all media and formats used by Digicel’s or its agencies, without further compensation, throughout the entire world in perpetuity. If a winner refuses to do so, they forfeit their right to claim the prize.
I. In addition to these Terms and Conditions, you remain bound by our My Digicel App Terms and Conditions of Use.
